K129f visa with estafa

Timeline

My fiance couldn't get nbi clearance cause she has a pending estafa case. Is the NBI clearance needed to process the K129f visa? please I need suggestion on how to waive pending cause aside from dismissing the case, it's been there for 10 yrs already and its not an active case anymore. Any suggestion will be pretty much appreciated...thanks

I think you need to dismissed that case first..NBI would not give you a clearance unless you show them papers that the case is already dismissed, like court order stating that case is close or dismissed...hope it helps....

I'm sorry but she need to settle the case first because the NBI won't give her a clearance once she's cleared. She might also need and NBI explanation letter for her interview.

NBI clearance is pretty much needed on K! visa, as a matter of fact its one of the documents listed to comply by your fiancee....and USEM verify all types of clearances so better be sure you finish the unfinish business before...

I suggest ur fiancée should consult with a lawyer ....or go to Hall of Justice of her hometown to ask for help with any of the public lawyers.

NBI is very much needed. No one gets exempted, unless you're 15 years old and below.

7. NBI CLEARANCE (Green Form): Applicants aged 16 years and older must have a valid Record Clearance (for travel abroad purposes) from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name, married name, and any aliases or nicknames ever used, including different spellings of all names ever used. An official letter of explanation from the NBI is required for any notation of “No criminal record”, or "No pending case”. For immigration purposes, an NBI clearance is considered valid only for one year from the date it is issued. You may contact NBI at (632) 523-82-31 to 38. The NBI website is http://www.nbi.gov.ph/.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yup you need a clean NBI or no one is traveling.

Let's clear this up a bit... I think the OP is asking about NBI for the I-129F portion of the process. No need there. But at interview time, you WILL need an NBI clearance, so you can apply, and use the extra time to clear up the old case. Then again, if the case cannot be cleared, you may have wasted your I-129F fee.

Your timeline is very confusing in relation to your posting. Your timeline shows you are an IR-2...

Are you just starting the K-1 process of filing the I-129F? You do not need the NBI for the I-129F petition, but you will need it for the actual visa application.

I talked to my wife on this last night, she suggested that being it has been pending for 10 years to go to NBI and request an NBI for Travel Aboard... verify that the estafa even shows up.

Of course her other suggestion was to pay the money owed.

apple21 - yeah, a motion filed but it takes 3 months for the court to get the result

Hank - the IR-2 is for my son, what does it mean NBI for travel abroad? I haven't started the K-1 visa yet cause I thought NBI clearance would be needed when filing it...
