My girlfriend and I are planning on getting married... Really soon, and moving to another state. Financially, the AOS is going to hurt (financially) but If it means she can stay, it's doable. I had a few questions regarding this matter I'll just get to the point. She is from Colombia with an F1 Student Visa, with 8 months remaining. What is our best option for a visa? Assuming we move, and break her current visa, with the adjustment of status, is she protected from deportation until we recieve her decision?

Welcome to the forum.

You may have the two primary marriage-based visa programs confused. guides6ly.gif In particular, review the Marriage-Based Visa Comparison chart:

Since you mentioned marriage first, review the spouse (CR-1/IR-1) visa programs first….there is no AOS with this process. There is AOS associated with Fiance(e) K-1 process. The K-3 is essentially obsolete, and is administratively closed by DOS.

You have some options, but there are differences and limitation with each. It is a personal decision.

Is she currently in Columbia or is she in the states already? If she's in the States, you can marry right now and file for AOS. Once your application is received by USCIS, she enters a period of legal status until a decision is made on the case and you won't have to worry about deportation during that time.

She doesn't need a new visa. Just adjust her status from an F1 student to a permanent resident using the instructions found here: http://www.visajourney.com/content/i130guide2 . You can move to another state, but she can't leave the US until the process is complete (or she gets an advance parole document).
