I am trying to help my friend to get her kids SSN and for them to get US passport. I will list her situation below:

  • She is a US citizen before the kids were born.
  • Kids were born in the Philippines
  • The father is from Iceland and he was able to get the kids an Icelandic passport using their Philippine's birth certificate
  • My friend is still married to the Father but technically not together anymore (Father is in Iceland now)
  • She wants to get SSN for the kids but Father doesn't want to sign anything.

Hope to get feedbacks from you guys.

on what basis are the kids IN the USA?

ie - what visa type?

Are kids in US?

What is the purpose of the SSN for kids?

Yes kids are with the mom here in the US.

Mom wants to apply for their medical coverage.

Kids are only on tourist visas right now since 2011

On tourist visa she cannot get the SSN for kids.

For Kids to get SSN she must get them the US citizenship.

The mother is a US citizen, she can petition her own kids.

The kids can't get the SSN because its a tourist visa.

If she will petition her kids, she don't need the husband to sign

What about the CRBA?

The kids had a Phil passport right?

as i understand if the mother is a US citizen the son is automatic be a US citizen

even he was born outside the USA.. what she gonna do is apply for US passport

and report the birth abroad too. then automatic he will get a SSN.

how old the kid?

since the kid is already here in the USA with tourist visa..

I am not sure.. maybe the mother she can apply a US passport to the kid .. that will be a DUAL citizenship

all she needs is go to post office and ask the requirements.. once she get the US passport, they need to go back to the philippines

since his entry here is tourist VISA then back here again using his US passport.. i am not sure.. but that's what i understand...

I am a naturalized citizen . My 2 kids came here through IR2 visa and they just became citizen when i was naturalized.

I think if the kids are here as tourists they can not get an SSN unless they have proof of us ctizenship.

correct me if am wrong.

If the mother meets the requirements of being a USCitizen

then

the easiest way for the children to get a SSN

is for the mother to apply for USA Passports at a Regional Passport Office.

Once the passports are in hand, then go to a SSA office and apply for SSN.

going to the post office is mostly hit or miss, the clerk there most likely is NOT trained on all of the stuff about USA passports - and

is possible the children qualify under the CSPA . If that's the case, that they do qualify, is best to get into a Regional Passport Office and apply.

CRBA is done at the US Embassy overseas. If the mother not pursue passports via CRBA overseas, then is best to pursue passports inside the USA at a Regional Passport Agency office.

Post offices are notoriously bad for giving out the wrong advice for chasing after a passport.

A Regional Passport Office is better, as the clerks there know ALL the rules.

If the mother is a US citizen why wasn't the CRBA done before departing for the US? Chances are good that they are US citizens by birth. If they entered on a tourist visa, besides having been overstying since 2011, they can't get a SSN with a foreign passport.

Best is to have their US citzenship status clarified by the State Department at a Passport Agency.

It's amazing how many questions can be resolved with a 2 minute Google search...
