Hi everyone, I have been a member here even before we start with the application, been visiting and reading stuffs, really helpful. Anyway, I have a problem with my application, got approved last April 29 and the NVC sent the docs to the US Embassy here in the Philippines. Since my fiance got some work to do and we got a target date which is in August, we just let the days, weeks and months gone by. Now, the problem is the police clearance, I didn't worry about it before because I didn't know that I will be needing one. I work in China for 2 years, 1st year in Zhengzhou, Henan and then I moved to Baiquan, Jilin. One of the requirements for the interview is a police clearance from the country you stayed in for more than 6 months, meaning I need to show them that I didn't do anything wrong during my stay in China. The problem now is I am already here in the Philippines. I called the Chinese Embassy here hoping that they can help but they said that they can't. So i research on things that I can do and found out that I can actually ask for my former employers help. I called them but then they told me that they don't know anything about police clearance that it doesn't exist, I explained and she told me that it doesn't exist still. I talked to a lot of chinese people that I know and they told me the same thing. I called the police station but no one seems to understand English. I asked chinese friends to help me translate but even them cant understand me, frustrating! I emailed and had been calling my employer for days now but she never answer calls neither reply to my emails. I don't know if it's because they've been doing illegal stuffs there and they might get caught if they started dealing with the police or just because they dont wanna help me. I also look for agencies that can help me but the ones I found are from big cities like Shanghai, Beijing, etc and they dont cater their service in other cities. I don't know what else to do, this is the only thing that is preventing me to go schedule for the interview. My fiance told me to just go and get interviewed but I am afraid that it will be the reason why they'll gonna decline my application. The other option is to fly back to China which is gonna cost us fortune and will eat up time but the problem is we don't know if my former employer is going to help me or not since they aren't even replying to my emails. Can anyone help me with this???

just my two cents..

Perhaps, you can take the risk of just scheduling the interview and explain the situation to the embassy (only if you will be asked -- less talk, less questions, less trouble).

The key is never LIE, you dont want to jeopardize your chances of flying to the US.

This is really tough but if its destiny, you can get by. Good Luck!

What type of Chinese visa did you have when you were in China? You may or may not need a police clearance report from China depending on your visa type. Go go the following link and scroll down to the "Police Records" section for details: http://travel.state.gov/visa/fees/fees_5455.html?cid=9015

Then you do need the police clearance. My Iranian husband was on Z visa and was living in Guangzhou when we went through the CR1 process. He had no problem obtaining the police clearance report. If I recall correctly, he had to go the notarial office in person to apply and it took about a month to get the report. Maybe you can post to the China forum and get more expert opinions http://www.visajourney.com/forums/forum/94-china/. People there are very knowledgeable and helpful.

Thank you so much Ma'am, I don't think getting from big cities like Shanghai, Beijing, Guangzhou and the like is hard. They've been telling me that they haven't heard about the police clearance thing, even my employer. Jilin is a big city but not a progressive one. I will check the link, thank you for your help.

Where you should really have this posted is in the Philippine forum, there you find others that have worked in China and had to apply for police clearance once back in the Phils. You should find much better answers there.

Also watch your time, the petition is only valid for 4 months from approval, the embassy can extend that upon request but you need to call them to get this done.

I believe you need a letter from USEM to request the police clearance from the Chinese embassy. I don't know this for fact but I seem to remember reading this.

Here is a link to the embassy instructions letter:

Hi Hank, the link is very useful, I have it saved on my favorites like a month ago. I went to the Chinese Embassy here and told me to go back to China to get a clearance. I called my employer regarding this matter and she keep denying that the police don't issue such certificate. Thanks for the tip, I will ask the admin to move this topic to the other forum since time is running though today I will pay for the visa fee and schedule my interview and get interviewed, I hope the guards will let me in for the interview even if I am lacking a document, if they really need it which I figure out they do, I would have to go back to China and seek help for someone who can help me acquire the said requirement. Thanks again Hank.

You shouldn't have an issue attending the interview, even if you are missing the police clearance (the guards do not screen for documents), the CO will most likely put a hold on your approval, then issue you a 221g for the police clearance from China. IF...IF ... IF

IF China actually will not issue a police clearance unless you are there in person then its possible the embassy knows this and will waive the requirement much the same as they do for UAE and others that will not issue the clearance through their consulate. Lots of IFs.... now you need facts.

Thank you so much Hank, learned moments ago that i can't pay yet, that I have to wait for the letter from the Embassy. Kinda confusing coz I have read that I dont have to wait for the letter but then I was advised not to pay yet and just wait for the letter then proceed to the payment, scheduling and interview. Thanks for your help :)
