Are you talking about the medical with a US approved doctor? Or at the general practitioner?

Packet 3 needs to be sent in when they ask for it, and not before. You are still waiting for your petition to be approved, right? Or have you sent it yet? According to VJ timelines, it will take about 60 days (though the consulate says 90 days) from the day that they receive the petition to the day that they approve it.

In your signature, you write that you are sending in the petition on August 1. That would put your approval sometime in October. When you get the approval, they ask for forms DS 230 which is kind of like "NOA2" for the DCF process. That is to be sent back ASAP, and then you can send in Packet 3 right after that. After you have sent both in, is when you make arrangements for her official medical (in Frankfurt, Berlin, Munich, etc.).

And, yes. Both the petitioner's and beneficiary's original birth certificate AND a copy must be mailed with packet 3.

JULY 12, 2013: NOA2 received.

JULY 13, 2013: NOA2 sent back.

AUG 15, 2013: Packet 3 sent in.

AUG 30, 2013: Husband's medical in Berlin.

SEPT 12, 2013: Received letter with husband's interview date!

SEPT 19, 2013: INTERVIEW. APPROVED!!

SEPT 21, 2013: Visa received.

OCT 5, 2013: POE in Newark, NJ (layover).

DEC 17, 2013: SSN Card finally arrived!

DEC 19, 2013: Husband (beneficiary) got his first job in the USA! And he loves it!

DEC 28, 2013: Green card arrived!

the medical exam by an approved us practitioner. yeah we're just putting everything together right now so when the time comes there will be no delays with NOA2 and Packet 3. so the DS-230 cannot be sent in the same envelope as packet 3?

I'm sure you can send in the DS230 and "Packet 3" all together in ONE envelope. I mean, I don't see why not, since they ARE asking for all of that. I would maybe separate them inside the envelope though. Meaning, DS230 and supporting documents (passport copy and letter they sent you) all paper clipped together. And then Packet 3 should have a separate paperclip holding it all together, perhaps with a sticky note that says "Packet 3, as requested." That way they don't have to go through all the paperwork separating things, especially since they won't need Packet 3 until AFTER they log in the DS230 and get that taken care of.

Again, this is just my opinion, as I have not gotten that far in the process yet. I hope if other VJ members see this they will chime in if I'm wrong.

yeah thats sounds like it would be fine as long as everything you stated is done. one last question, the DS-230 only has to be completed for the beneficiary correct? not both of us? sorry for so many questions haha.

No, unfortunately not. My mother sent me another one in the mail so we will see which one gets here first. I did ask at my local post office today if there happened to be something there for me. There isn't. :(

Just a quick update to share that I went to my interview in Frankfurt on Wednesday and I received my visa on the mail today!!! :)

We're so happy! We had tickets for October 20 and were a little scared that we might lose them, but now everything is going to be just fine.

Hi everyone,

My hubby and I are married already 3 years this summer. We got married in Munich, Germany and I have been living here since 2009. I am US citizen and my husband was born in Munich but has an Italian passport. The latter of which made it really painfully fun to legally get married in Germany.

We have finally decided to begin the green card process and I am a bit lost. I will hopefully be sending out the I-130 on Monday to Frankfurt. Do I have to already attach the I-864 form or does that get sent along later? I am a stay at home mom to a toddler and we file taxes jointly, will that be a problem?

I am debating if I should consult a lawyer, or do I really need one? Any advice, tips would really be appreciated, as this process seems very overwhelming.

Hi Sykla,

I think when I started the process, I started off reading the USCIS website (http://germany.usembassy.gov/visa/) and then I came here and read things, and confused myself. It's easy to get ahead of yourself when trying to figure out the process.

In short, to answer your question, NO, the I-864 does NOT get sent in with the Petition I-130. It will get sent in at a later date. If you follow these directions to a T, you should be fine and not need a lawyer (unless your case has something else weird about it that you haven't mentioned). http://germany.usembassy.gov/visa/iv/apply/

The Petition I-30 (the form itself) and the supporting documents that IT ASKS FOR (not the I-864) get sent in when you start.

Lastly, the I-864 is, in my opinion, the most confusing document ever. Yes, you still need to attach a copy of your taxes, or a letter stating why you did not file your taxes (again, this is later in the process, not now). The fact that you filed jointly doesn't matter, as you are a US citizen, and US citizens are required to file their US taxes regardless of where they live.

I hope this answered some questions. I am not a professional at this immigration stuff, but I am about halfway through the DCF process, so I have a little bit of experience with the stuff thus far.
