I've posted a question similar to this one and have been looking but can't seem to get a concrete answer. When it come to filing the i-864 my father is going to be the joint sponsor since I do not make enough money. I did not file taxes in 2012 (April 2013) so I wouldn't send any tax information for that year. My father, did because he DID work and make money. I know I have to fill out the i864 because I'm the petitioner but will I have a problem if I don't send my last three tax returns. I'll send my dad's because he's the sponsor. Thank you thank you thank you for your help!

Why did you not file taxes? The answer depends on that.

If you were not required to file taxes (made no income at all), then it will not be a problem- it was the same for my USC husband, who lived abroad with me for a while and did not work during those years, I supported us. If your case is similar, you simply write a short letter explaining why you were not required to file.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for your answer penguin. I didn't file because I don't live in the US and I'm currently looking into having to file for living overseas (I had NO idea). I was just wondering 1.) why on earth would I need to since I'm not techinically sponsoring him. I know I have to because I'm the petitioner but I thought that the "evidence" would be from my dad not myself since I didn't make any money.

You need to file taxes if you made income abroad (backfile- it's not that complicated). You will not be approved without showing that taxes have been filed, or explaining why you were not required to. This is not only about you being able to support your spouse, it is also about you following the rules, and filing taxes is one of the rules.

Unfortunately a U.S Citizens duty, no matter where they live outside the U.S, is to contribute through taxes if they are legally working. I'm not sure if you fall into this category but you maybe eligible for the 2 month filing extension. This gives you until June 15 to file, you can also request another extension up to October. You can find the information here:

is very rare an I-864 is utilized by the IV Unit when adjudicating the K-1 visa application.

Perhaps you are thinking about the I-134, instead?
