How much does an RFE delay your case?

Hey guys.. we got notified by email of an RFE heading our way in the mail... I have a feeling it may be because my passport photo doesn't meet requirements (even though I had it taken in the US! - I was reassured by the girl in Walgreens that it would be fine. Oh well). But anyway, on the email it says that a "new processing period" will begin after we send the requested documents.. Does this mean we are back to the bottom of the pile?? I know we are lucky in that we are only 5 months into our wait, compared to others who have been waiting way beyond the average processing times, but I really don't think I could bear another 5 month wait or longer :(

We got one for a typo. I sent in the corrected from ds-230 11 days ago. I believe what happrens is they just dont get aroud to opening their mail for 2 or 3 weeks. But when you call they should be able to tell you exactly what is wrong with your file and you can get started on the correction right away. No need to wait for the snail mail. I FedEx'e our form and had it back in their mailroom within days. Now it just sits waiting for someone to open it. I know it really sucks. I miss my wife so much. Good luck

Actually USCIS will not release any info on the RFE over the phone. We tried it. All they are authorized to say is that you have a RFE being sent out on such and such date.

As for OP's question, no, your case doesn't go to the bottom of the pile. It's simply in suspense until they receive your response. Once they do, your case is opened again. From lurking on VJ, it seems this USUALLY takes a week or two.. At most, a month.

Okay. Well that's set my mind at ease a little, at least it should hopefully just be a short delay.. I'm so curious to know exactly what they are requesting, as I thought we had everything they needed and we checked, double checked and triple checked the package as you do. Ah well, hopefully it's just the photo. Thanks so much for your replies! Good luck to both of you on your journeys.

The best thing to do with an RFE is to reply promptly, so as not to incur any more delays.

From your timeline:

"Based on timeline data, your I129f may be adjudicated between July 25, 2013 and August 12, 2013* (RFEs at the California Service Center typically add an extra 14 days, which has been added to the estimated processing time)."

Good luck.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Thank you :) We just have to wait and find out what it is they need, but as soon as we know we'll be getting it sorted and sent.

After USCIS received ur response, they will give a 60 days for a review. Our RFE took us close to 60 days. Yes, correct you need to reply at once. For the waiting time after RFE response, it varies. Some got thier NOA2s just a matter of week , even days.

When your file gets to a person's desk they have to approve, deny. If they are unable to approve they will RFE, essentially putting your case on hold, once you answer that RFE appropriately they can make that decision ASAP and hopefully approve your case.

*** Thread moved from K-1 Process forum to the Case Progress subforum. ***

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Good luck to you both. They received my corrected form 14 days ago. It sits in their mail room, unopened apparently. I hope the two of you are luckier than we are.
