Baby is 18 months....

The man only needs to be there at the conception, not the birth smile.png that is, 9 months plus 18 months is more than two years.

However, the OP has said that he left Thailand in October 2011 and the NOA2 date is 11 months later, so the meeting within the last two years should not be the problem (as long as it was properly documented with the petition). Even if it was not properly documented, I think it would probably trigger an RFE rather than a denial.

I do wonder whether CSC suspect that they are already married? However, this is all conjecture until the OP receives the letter.

I was present for his birth, and left after he was 3 months to find better work to support us in the states. I applied for the K-1 11 months after I moved back because I could not afford to get it done immediately. I have lived in Thailand for 5 years straight, so moving back was not that easy to adjust to esp looking for work, finding a new place to live and sending money to them to make sure that they are well taking care of. In that eleven month span, I did fly back and spent a week with them and did the process for my son’s citizenship at the same time. We thought about getting married when I was there. But it was Songkran holiday which lasted a whole week and everything was shut down and I could only take off from work during that time. So we decided once I settled back in the states with work, finances, etc I would file for the K-1.

So that everyone calms down. There are only hand full of reasons why someone can get denied at I129F stage:

1) Not free to marry

2) No meeting within last 2 years

3) Not responded to RFE (to prove above two points)

4) Already married to the beneficiary

There is no other possible reason for denial. I am sure it is one of the 4 above. Others: please, calm down.

I know it seems obvious that you were there in the past year and lived there with her in 2011, BUT you stated you sent them documentation for meeting in 2009. Did you include info about your trips after the 2009 meeting. IE ... plane tickets, hotel bills, pictures etc...?

Just a thought.

I was dating her when I was living there. We moved into a house in 2010. I sent pictures of us and our house, gchat logs when we started dating, passport info of me living in Thailand from 2007 til 2011, never stayed in a hotel with her, and sent info of my only time flying back to Thailand with my consulate appointment data for my son’s citizenship and fiance.

Whoow Greg n Veronica. I would kindly inform you that this is a forum, not a love chat. If you feel I am not supportive enough, overlook my comment. I did get that a simple email is all he has now, my comprehensive abilities should be none of your concern. People need to disclose their circumstances in order not to confuse others.

As to fsuinla, your timeline tells me that your consulate is Armenia, whereas you mention Thailand. I had a few problems throughout my journey too(at an interview stage). Maybe they sent you an RFE that got lost in the mail, or it may be a dozen of other things.

A couple of weeks after the US embassy in Armenia received my papers, I sent them an email about scheduling an interview. This is what I got as a result.

Dear inquirer,

Please be advised that last week you were contacted and asked for coming to the embassy for receiving your invitation. You answered that you are unable to come so we scheduled you on Friday, you didn’t show up. You can come to the embassy on 17.Aug.2012 in order to receive your invitation for your interview on 23-AUG-2012.

I had not received a single call from them, so apparently there had been a misunderstanding of some sort. This case is way different than yours, I am just telling this so that you know mistakes happen.

I'm no immigration expert but if you were denied before you got NOA2 that means there was a problem with the background checks...that's really all the service ceters do... check for proper documentation and perform background checks

There could be many other reasons. This is the reason for the RFE process. If the O P had something terrible in his past I am sure he would not be questioning his denial here.
