RFE Received... yet EAD in production?

Hi friendly people!

I'll confess to being a tad confused. I have received an e-notification this evening that my pending I-485 application is now in "Request for Initial Evidence" stage. I shall only know what that specific evidence is when the physical mail is received, of course.

My question pertains to the I-765; yesterday, that status changed online to "Card Production". However my understanding has always been that, as the I-765 was submitted concurrently with the I-485, if there's an RFE on the main application all other applications are also placed on hold. Or more specifically, the clock is actually reset on the I-765 once evidence is received.

Since it's now a weekend, and the information I receive from the 1-800 USCIS number tends to, at best case, be somewhat misinformed, I was hoping someone here may be able to point out what has possibly happened here? Can I expect my EAD, or is it likely now that it's on hold? Also, as there is indeed a very urgent need for my to have my EAD card (health, epilepsy issues that I shan't bore you with here), is there any possibility of expediting in these circumstances?

How does having a work permit help you with health issues? That is what will matter on whether or not an expedite will work.

The EAD could have been approved and sent for production, but put on hold now because of the RFE. It could also be that while you were only notified yesterday of EAD approval, it's actually a little delayed.

The EAD/AP aren't reset due to an RFE, they're just put on hold. once you reply successfully they continue where they left off.

Despite the common notion that everything stops with an RFE, I've seen posts over the last five years where EADs were received while the I-485 had an RFE. Maybe you got lucky. The proof could be in your mailbox soon. Do an update when you have further info.

Not a problem. Basically, in order to afford my medication and obtain health insurance I need my EAD card (especially for the latter)

For those of you who are interested, here's what happened:

The RFE on my I-485 was for a missing signature on the I-864 Affidavit of Support. A lady called me from the NBC after I faxed in my expedite request for the EAD, saying that she had no problem whatsoever in expediting in these circumstances, and just needed me to fax over a copy of the document sent in the RFE, complete with signature, in order to get this done.

I did this in the morning, I had my notification that my EAD was being sent out to me by the evening, and have now mailed across the RFE to the NBC for processing.

Excellent. that validates that the RFE needs to be successfully replied to before they can finish the EAD. Edited May 9, 2013 by Vanessa&Tony
