Employment letter for NVC!

Hi all. I have 2 questions I was hoping to get some help with. First off, I saw on Visa Journey somewhere that apart from the Affidavit of Support and tax transcripts the petitioner in the US also has to send a letter of employment. However, I have not seen this on any official govermnent web sites. Is this necessary? Also, my husband is thinking about changing jobs. Does he have to be employed at the time of the visa interview? and would he have to notify the NVC of having changed his job or is that just valid for change of address? Thank you!!

It's not required, but I sent one because my income increased significantly from 2011 to 2012 and again from 2012 to 2013. So even though I met the requirements for each year, I wanted them to be extra sure that it was all good...

I too have been considering looking for a different position. If I do that, I intend to notify USCIS if that's where my case is when and if I make that decision (am anticipating having to file a waiver, which will add another 6 months or so to our case despite it being at the consular stage now).

Part of the Affidavit of Support is the petitioner being able to prove that they can afford to support the beneficiary. This includes showing recent pay stubs and employment letters which will indicate that the information they have provided is accurate and adequate to meet the requirements. If he is starting a new job at the time of needing to prove this he might not have sufficient evidence backing his statements. Please keep that in mind depending on your timing.

Although it's good to provide current pay stubs and an employment letter, I've had multiple conversations with the NVC and they told me that it's either-or for their purposes. They evidently consider your AOS complete if it has "proof of current employment and income" in the form of either stubs or letter. Oddly, my AOS was approved without either stubs or letter. I had transcripts of 2009, 2010, and 2011 taxes, and included the full package the accountant sent for our joint 2012 taxes, and the 2012 taxes were fairly recent, and my income has held pretty steady with annual raises, so I guess they thought that was enough. I will send my husband my most current pay stubs for him to take along to the interview, though.

I submitted the following with AOS form

- photocopies of 2012 tax, along with W-2 and 1099 forms

- transcript of 2011 and 2010 tax

- employment letter verification

- last six paystubs

I'd ask your husband to wait to change jobs after your visa interview is approved. Better be air-tight as possible during this process.

Sort of. Actually, it's a best practice to provide evidence (Evidence and proof are not the same thing.) of current income. This can be done with EITHER and employer letter, a recent pay stub (One is enough if it shows year to date income.) or you can do both. I prefer using a recent pay stub. It's far less trouble than getting an employer letter, for most folks and actually BETTER evidence of current income.

The self employed, use their 2012 tax return as evidence of current income, as (for the self employed only) it isn't "income" until it appears on a tax return.
