Removal of conditions interview question...

Hello everyone,

So I wasn't very clear with my last post and I really need to try and find an answer to this! To summarise my situation, my (ex)-wife and I are now divorced, I received my 2 year conditional green card and unfortunately we divorced shortly after. I applied for the i751 removal of conditions asking for the divorce waiver, as we were no longer together. And several months of waiting I finally received my interview notice, however on the notice it states I need to bring my spouse. This interview is in response to removing my conditions as a permanent resident, and hopefully granting my 10-year green card. Because I am divorced, do I still need to bring my ex-spouse!?

Hopefully this was a little clearer and somebody will have some advice. Also, I'm sure it's been posted a million times, but what should I expect in the interview? How can I prepare other than bringing proof of our relationship?

Thanks so much.

Sam

Yes, you do need to follow the instructions from your interview notice. In other words, yes, you do need to bring your spouse. Sounds like USCIS is trying to verify if your marriage was indeed a bonafide one by requesting to hear your ex-wife's side of the story.

I have never heard of bringing an ex wife to an interview.

So my answer is no

She might hurt your case. You will do better alone and you are removing conditions alone

Expect to be asked why you divorced so quickly.

Expect to provide joint account information

If they want her, they can find her.

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

PLEASE EDIT YOUR TIMELINE IN YOUR PROFILE SO OTHERS CAN LEARN HOW LONG EACH STEP TAKES IN THIS PROCESS

I would take the divorce decree and be ready to explain how the relaionship started and why it ended so quickly after AOS. It sounds like you got the wrong form letter for ROC without the waiver instead of the one for ROC with the waiver. The real question is would you ex go if you asked her? Do you want her there? Since you filed for a waiver you are ROC without a spouse, so why would you bring you ex along?

Good luck,

Dave

Hi! I also am removing my conditions after a divorce although I filed with a waiver and divorce decree already.

I received an interview notice few days ago also saying that "You and your spouse are required to appear at... for an interview by a USCIS examiner in connection with the petition to remove...." and "You and your spouse are requested to bring the following... (the usual list of supporting documents)". The interview notice came on a plain white paper, no fancy watermark/color ink stuff as on the previous notices. I received the same notice (words and paper) last October for the interview that I had to reschedule, and both times I didn't pay much attention to the words "you and your spouse", thinking that they just must have one form for all cases.

Now your post got me worried - is this wording unusual? Do they send waiver people notices addressed to them solely?

I will not be able to bring my ex-husband to the interview. 1) we are not speaking much due to mutual hard feelings and 2) it was a real pain to bring him to the AOS interview, cause he hates talking to authorities. It's just not happening.

Guys, what's your insight? What did your waiver ROC notices say?

Don't bring your ex, do bring all documentation you filed and your divorce decree.

In Arizona its hot hot hot.

I also filed a waiver due to divorce. I received a letter from the CA Service Center indicating that my case was referred to the field office (Santa Ana). That the Santa Ana office would be advising me on my interview date.

Please keep us posted so I know what to expect.

I am considering taking an attorney with me to my interview.
