Hi i need help to file for adjustment of status for my fiancee before her 90 days k1 visa expires in 1 weeks. we already married. i just need the forms and to go to get her social security number. thanks for any help!

She came on the k1 visa after it was approved. We married a week ago. I have the certificate, i was told that anytime after i marry i can file for the adjustment of status, and ssn. but i just had to marry within the 90 days? if i did all for nothing and she will be still illegal now even though we went through the process and did all correct. i feel so crushed

Dont worry. If you married within 90 days of her arrival she is not illegal. Even if you don't apply for her AOS before the 90 days expire, she will not be illegal. In that case she would not be here illegally so much as she would be considered 'out of status'. If you have the certified copy of your marriage you can send in the paperwork to get her AOS started. You should have received the certified copy in the mail. The copy you received at the ceremony is not the certified copy you need.

She won't be illegal, it's jut that you missed the window for getting a SSN based on the K-1 visa, since it is about to expire. You can get the SSN right after she arrives, and before you marry.

Her SSN doesn't "make her legal" so it's not a big deal. There will be another chance to get one.

You do need to be married to file AOS. There is an AOS from K1 guide at the top of the page in the "guides" section that you can study.

Her SSN doesn't "make her legal" so it's not a big deal. There will be another chance to get one.

Can i use the g-325a forms we filed with our i-129 visa petition by just copying themm or should we make new ones?

What if we went to file for her ssn. tomorrow morning while her k1 is still valid? since it expires the 25th of april.

and does anyone how much the aos form costs?

Dont worry. If you married within 90 days of her arrival she is not illegal. Even if you don't apply for her AOS before the 90 days expire, she will not be illegal. In that case she would not be here illegally so much as she would be considered 'out of status'. If you have the certified copy of your marriage you can send in the paperwork to get her AOS started. You should have received the certified copy in the mail. The copy you received at the ceremony is not the certified copy you need.

thank you for the response, i have the marriage certificate they gave it to me at my local court house, with the seal on it. i feel a little better now.

Please read the guides, compare the guides in VJ to the USCIS requirements. Iffy on the SSN as you should have applied for it about 2 weeks after her arrival and then gotten the state id or dl. Apply for your AOS asap, after you get your requested docs together, and followup medical etc. If you do not file in the 90 she technically is out of status, getter done. A friendly hint, you have been here since 2009, it will get easier if you follow the excellent guides and do some reading about the mistakes others have made so you do not do them. If you still have issues maybe a professional is in order.

thanks im just nervous and panicky, when it comes to this. are they suppose to receive the Aos form before the 90 days are up? im looking at the checklist for the I-485 package i need to send and i have everything im just confused about if i should make new g-325a forms or use the old ones we used for our 129f package. since we're married i don't know if we need to change it with her new last name. and i cant find the fee i need to send with the i-485 package anywhere.

You need to relax. You are obviously unprepared, and you did not study this process until now. That's okay. But to proceed in a nervous state will cause you to fail.

Calm down, and start studying. AOS is more complex than K-1, and there are a lot more forms needed. Don't photocopy old G-325As - make new ones. You need to send original forms.

If you rush you will get RFEs or worse, a denial.

You can send AOS in after the I-94 expires. The sooner the better, though. But sending in an incomplete package is way worse than waiting another week to get it right.

The fee is all over the place, it is $1070.
