I am about to file for a fiance visa and I have just finished a very expensive vacation visiting each other which has put my bank account temporarily in the red. I work two full time jobs and make roughly 50-60,000 a year but my bank account is often empty and I rent an apartment and have no assets other than my car. I did not know I had to provide this information, I thought I just needed to file I-129F and the G-325. I read that I have to have my employer write a letter too? I don't want my employer in my personal business! And my bank account is going to reveal that I live pay check to pay check. I'm spending a lot of money taking care of debt and paying for my fiances living expenses abroad and have no money to save. I'm so disturbed that I have to file this form. Can some one please help me understand whether I am over reacting or this is going to be a big red flag in my application. I thought I just needed to verify I have a job paying more than 20,000 a year. Not that I have assets and money in the bank.

Welcome to the forum.

It is actually very simple. If you don't want to play USCIS's game, then don't. If you want to legally get your foreign fiance(e) into the US, marry, and get on with your lives, then you will have to play USCIS's game by their rules/regulations/instructions. The choice is yours.

Good luck.

Have you read the guides yet? going by the guides will help you a lot with your petition

Since you are working on sending off your petition you don't need to worry about the I134 right now. you will have to fill it out once your petition has been approved. I believe as long as you have enough INCOME, you don't need to reveal how much savings etc you have in the bank. so you should be fine if your current income is above 125% (100% if you are military) for your household size. but you will need a letter from your employer as proof of your current income and your tax transcripts from the last few years.

I hope this helps, read through the K1 guides on here. it'll save you a lot of time and a possible RFE B-)

Thank You for the help. I am single without kids and have temporary debt, no major debt so I think I will be good. And by the time I get to that stage I should have my debt settled and will most likely be on my 3rd job making 70,000 a year.

You will be fine- with a well paying job like you have, you won;t need to show assets. You will need your tax filings and paystubs, and a letter from the employer is recommended but not necessary with stable income.

I read yesterday that income for the I-134 is actually 100% FPL not 125. 125 is for the I-864.

Embassys and consuls look at the 125% because you have to prove 125% when you get to the USA.

100% is actually used for military people only generally.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I saw this yesterday on teh travel.state.gov site. here is the link http://travel.state.gov/visa/immigrants/types/types_2994.html The info is under "Do the Same Income Requirements Apply to Form I-134 as Apply to From I-864".
