If you get married, you won't be filing for a k-1 as that is a fiance visa.

Here

and

Research and read and then ask questions :)

Good luck.

From what i've heard, I wouldn't get your hopes up about that tourist visa.

Edited to say: If the paperwork is "sooo" confusing, you might want to consider consulting a qualified immigration attorney.

Hey, Just wanted to let you know that you might be better off posting this in the Regional Forums - Middle East and North Africa. There are a few people who have done DCF in Algeria with a lot of success and they can probably give you better advice. If you do a search you might be able to find their old posts. I believe that you need to be in Algeria for about a month in order to file all the paperwork for the marriage. Then you can go to the Embassy and file the paperwork for the visa.

My fiancee is from Algeria as well, but living in Spain :-)

Its very difficult for Muslim men from a country such as Algeria to get a tourist visa to the US, so I would start to think about going there.

Good Luck!

anniev,

My question is, how much older are you than he?

Even if you're not older than him, I suggest you start by having a consultation with an immigration attorney to review your situation and get advice on how to prepare your I-129f petition and his subsequent visa application. Try to find an attorney who has experience with Algeria.

How exactly is he your fiance if you have not met?

After many months of talking online and on the telephone he asked me and I said yes.

Anniev, You have three general choices. 1) Meet your fiance, take lots of pictures together and other evidence of meeting and file for a K-1 visa (fiance visa) with form I-129F. This requires you get married within 90 days of his arrival in America. This is still considered the quickest method. 2) Go to his country, get married and return to America without him. Then you file K-3 visa (spousal visa) with form I-130. Once his visa is approved and he arrives you need to file for adjustment of status (permanent status). 3) You can file for Direct Consular Filing (DCF) at the U.S. embassy in his country. This is not available in every country and has some very specific requirements. Probably not the best in your case.

If you want a recommendation, to go Algeria and meet with him. Spend time getting to really know him and then if you are still in love and want to marry start the fiance visa process. You really want to spend some time together because you need to have that special chemistry when you are together and not just on the phone or internet. This is a serious step you are considering, so take your time and make sure. The visa process is long and frustrating, so you need to know he and you are strong enough to weather this storm.

Review the various types and consider your best options. The guides here are great and very informative.

Good luck.
