Hi,

After receiving my K1 approval a couple of weeks ago I was left confused by one of the included instruction letters,

it states that after we get married my spouse will need to file the I-130.

All the information on this site has been super helpful in answering my questions so far by just searching through

other threads and guides, but on this subject I'm finding conflicting answers and the one piece of official

document I have states the opposite of the info I'm finding here.

Some more background info..

Fiancee applied through form I-129F about a year ago, it went smooth and in November I sent my papers to the embassy

here in Stockholm Sweden, was called for the interview at Jan 3rd and that went shockingly easy, I was so nervous

for it after reading some stories on this forum but the interview was over in less than 5 minutes after just asking

some general questions about our relationship, they didn't ask for 1 piece of evidence and just said I was approved.

About 1 week later I get the yellow envelope in the mail, containing my passport, the packet to be handed to the border

ppl on arrival and this letter with the info about my arrival and I-130 requirement.

I've attached a scan of said letter as a .jpg.

So what I'm wondering is pretty much this..

1, After getting married, is my Fiancee really required to file the I-130?

2, Ill be moving to Sacramento, CA.. Where is it best to file the I-485(AOS)/I-765(EAD) and advanced parole to?

The local Sacramento office seem to only do the I-485, so do I send that in first and use the notice to send the

Other 2 elsewhere, or is it best to send it all to another office that does all the forms?

3, Do you at any point need to get your home country's version of a marriage cert to get one over there? And how did

you guys deal with reporting the marriage to your home countries.

I'm thankful for any response as it's kind of overwhelming to figure all this out while you're also busy packing and

arranging transport for pets and all my stuff, and I'm sorry if this is answered elsewhere, I did try to look around before posting.

The guide here on VJ about adjusting status on the K-1 should give you all the answers.

About getting your marriage "registered" in Sweden you need to send a certified copy of your marriage license to skatteverket. If i don't remember completely wrong there is also a blankett to fill out. But that one you can find and print on there web page.

Welcome to the forum.

Here is the link to the GUIDES section pertaining to Adjustment of Status (AOS) from K-1 visa:

http://www.visajourney.com/content/k1k3aos

Not sure what to make of the I-130 business, as that you are coming to the US on K-1 fiance(e) visa??

The letter seems to contradict the DoS Nonimmigrant K-1 Fiance(e) visa FAQs:

http://travel.state.gov/visa/immigrants/types/types_2994.html

Good luck.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

I wouldn't worry about that I-130 business, we had issues in the past with Stockholm and weird forms when we were going with the K1. It could have been an old letter or someone added something they shouldn't have.

1. No. The only time a K-1 visa holder would need to file the I-130 is if they waited longer than 90 days after entry to marry

2. All K-1 visa holders send their I-485/I-765/I-131 to the Chicago Lockbox address, regardless of where they live.

3. This seems country dependent.
