07/14/06 - I130 - Received NOA1 (I-797C)

14/12/06 - I130 - ****APPROVED **** WOOHOO!!!! / But Retained..boohoo...01/03 -

I-824 sent to INS for Transfer of I-130 to NVC

01/09 - 200$ check cashed. No confirmation in mail yet..

01/11 - Touch

01/13 - I-797 receipt received in mail...

01/31 - Touch

07/31 - Approved I-824 / Sent to NVC

Capt'n Ewok has this as an announcement at the top of this forum and the CR-1 forum, as well as in the Immigration News Forum.

I've been up all night and too sleepy to take it all in, but the new procedures with the filing of the I-824, Application for Action on an Approved Application or Petition look like they could be interesting. Will have to absorb it later after some shut eye.

I noticed the announcement as well. I realize that in it's own way the USCIS is trying to make things more efficient, but I'm frustrated to have to do an extra step, as I've always intended that my husband would go back to Canada for the consular CR-1 interview - I really hope the new form doesn't have a fee, although I'm guessing it will :( I'm going to look into it later.

Capt'n Ewok has this as an announcement at the top of this forum and the CR-1 forum, as well as in the Immigration News Forum.

I've been up all night and too sleepy to take it all in, but the new procedures with the filing of the I-824, Application for Action on an Approved Application or Petition look like they could be interesting. Will have to absorb it later after some shut eye.

I wonder what they mean by "unless the petitioner clearly indicates on Form I-130 that the beneficiary will use the consular process".

I hope that's what that means, because that's what I did. But it didn't seem to make sense in the context of the rest of the news release. I thought they might mean something more than that, but I hope you're right. Anyway, I'll stop worrying about it now :)

Evil indeed Riblet. It all comes down in getting even MORE money from us!!!!!!!!!!!! Ugghhh. See for me it will probably screw me up because I have still not decided if I will go through with my K-3 or I-130 as I will have to go via consular proceedings.

My case was transferred to VSC so I am one of the those customers.

But this notice is really unclear. For instance, if my I130 is approved before I129F and I choose applying for CR1, does that mean I volunteerly give up my K3? At the time I have to make the decision, HOW would I know my I129F might just ready to be approved????

Going by the press release the I-130 once approved will be held by USCIS and not transferred to NVC if there is no clear indication on the I-130 that one wishes to apply for the immigrant visa at a consulate abroad. If one wants it transferred an I-824 Application for Action on an Approved Application or Petition would need to be filed.

This is going to be a pain in the butt and the pocket for many, which is usually the way when their is a new system implemented. I do wonder though if it is going to apply for petitions already filed. Time will tell.
