If you are out of status but PD current I suggest you to go back to your country and do Consular processing because for adjustment of status you should be in valid status.

Almost there! PD is 12/27/2010.

Today I sent the consulate an e-mail about some documents and (Why not?) asked about my case number. They still don't have record of my process, still with NVC...

If he leaves US he without adjusting status he can be stopped 3-10 years to come back because he's already out of status. If anybody have this kinda situation now

Thanks for info, Ya he's overstayed more than 18 months. Any other way than waiting for spouse to be citizen?? Can he apply for status adjustment from US?

I don't think so...It will be better to consult with Lawyer....Good Luck !
