We received an email notification on Jan 24 saying that an RFE notice was sent to us. 10 days later we still didn't see anything in the mail and I started to panic. Believe me, I never had any trouble with the post office although a lot of people here are not happy with them.

So I called the Service Center. I was told they could not disclose any info until after 15 days if I still didn't have the mail.

So I waited patiently and called again on the 15th day. The guy said he would request the RFE notice to be sent again, He also told me I couldn't contact the Service Center until 15 days had passed if I still didn't receive the second notice and all this waiting time wouldn't change the response due date for the original RFE.

I asked what was requested in the notice so I could prepare the document and was told I had to wait for the notice.

I asked normally how long the RFE gave the applicant to respond and was told it was case by case.

To make things more complicated, he was nice enough to transfer me to the higher level. 45 minites waiting on the phone finally I got to talk to a guy God knows where he came from. His English was so awful I could hardly understood what he was saying. Well, he said the system showed there had never been an RFE sent to me! when I asked how come I got an email notification and his ID number for my reference (I asked very politely), he started yelling at me that he was an officer, not a contractor ,and he didn't have an ID. Then he hung up on me. I've never talked to anyone in the US, even government officials, who was that rude!!!

So now I'm confused more than ever. I can see online in the case status that my case is pending on further evidence. And it's almost 4 weeks and we still don't see anything in the mail.

Does anyone know hong long they typically give the applicants to respond to the RFE, 30 days, 60 days? If it is 30, then in a couple of days it will be 30 days in my case. Will they just reject my application? What do I do then? It is not our fault. we cannot send them anything if no one tells us what they are asking for. My stomach just turns every day after I check the mailbox and I just want to cry.

RFEs are usually given 87 days.

If by the end of the 87 days you have not responded to the RFE, or if you responded without the evidence that USCIS sought, then your application will be denied.

I would make an Infopass appointment at your local office at your earliest convenience and explain the situation to them.

omg i am so scared now!! i feel like thats what happening to me right now!! they sent me email saying that they sent me RFE on the 8th of february and i still didn't get it!!

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

RFEs are usually given 87 days.

Thank you so much Hypnos! 87 days sound much better. Now here is the latest twist (in a good direction?):

I didn' t make an info pass appointment last week since the weather here was too bad to venture far out. On Friday, I finaly found a letter from USCIS in the mailbox! However, it was not the letter for RFE, but a I-797C notice for an interview on April 1st! It says "Request for applicant to appear for initial interview". So I guess the rude officer was right in saying that an RFE was never sent to me? Otherwise, there shouldn't be an advance of my case from pending RFE response to an interview, should it?

My question is the wording "initial interview". Would there be a subsequent interview or is this the interview that is the last step for them to make a decision? Should I still make an info pass appointment to find out about the RFE thing? My online case status still shows I-485 was last updated on Jan. 24 for RFE. Maybe they haven't updated it to interview?
