I'd get married in Haiti and refile the CR-1.

It's going to take a long time either way, and you'll have to re-file either way. Might is well make it official so it doesn't look like an old friend helping someone come into the US.

thx a lot....how long you think we have to wait to start this process???

The small amount of visits could have been the red flags. I think you can get married in the States. However, he cannot stay and AOS there. He has to go back to Haiti. Some people have gotten married on a Work/Visitor visa and stayed in the States to adjust their status, but it is not legal and comes with lots of headaches. And since he already had a denial for the K1, I would recommend doing everything the legal way :)

Maybe they are wondering why you haven't gotten married in 6 years of knowing him? Only being engaged after 6 years might seem like the commitment might not really be there to them. I would marry and go the CR-1 route.

Hi there...I was just refused lst january 31 with my K1 interview...The CO asked quite numerous questions about me and my fiancee...He is 15 yrs older than me...We're both never been married but with kids...As i was having the interview, I was thinking that everything was going well...suddenly, as he was looking at the I-134 form, he asked me who were the people living with my fiancee...I told him that those were his kids, 2 kids carrying the family name of their mother...then he asked me again..Didn't he marry the mother of these kids? I replied with NO...Then he stood up and talked over his headset, tellin me that he couldn't find any commitment from my fiance...and He can't afford to support me when I get to US...I was stunned because he didn't even bother to look at the pay stubs and W2, & 1040, he's earning above poverty level...but I was told verbally to tell my fiancee to write a letter then send his bank statement...

We consulted an immigration attorney, she just told my fiancee to come to my place and get married...We were disheartened by our sudden fate...BUT...I wanna tell you something to give you some points to ponder...

Refusal/Denial are heartbreaking but you need to take time to think it over...stay calm...tell your fiancee to write down the questions that were asked by the CO then his answers...and You as the petitioner, send an email to the USEM where your fiancee had his interview...ask them about the decision..then do a lot of research about people who experienced the same...

Don't come up into giving up and consulting lawyers...YOU follow your instinct but before that FOCUS....I let 2 weeks passed before I came up to the decision that I have to comply to the requests of the CO...We gambled and we WIN....

I'm just hoping that the USEM will be prompt in responding to your inquiry...try to inquire first ...then try to resend the evidences of your relationship like photos, and chat logs or whatever that you think will be useful...and make a good letter to the consul stating your situation like what took you so long to decide on marrying, and state in your letter that you know that process well if you will be given the visa...

I'm telling this because we were in your shoes almost 3 weeks ago...The Immigration Attorney in US refused to help us in responding to the 221g, but I had to follow what my instinct suggested...I read a lot, and asked different sites that offer US immigration cases...and by God's grace...I was issued the visa yesterday...You'll never know unless you try...If this won't work out, so do the CR1 route...

Being together for 6 years and only having met twice is a red flag. And with a K-1 you must marry in the US, it is a requirement

we didnt meet only twice, when did i ever say that???? we saw each other every summer, b/c i was a student, n i still am.. i said after the earthquake we only saw each other 2x..

I have to admit I'm a bit anxious because my fiance is 15 years older than me. We both were never married and neither of us has kids. I just hope that the CO believes that love knows no age boundaries!

Try to fight the decision - it's not lost yet! Look at sammdt's story. You can do it, too! It's not fair that they deny two people who love each other to be together for the rest of their lives. And if you lose the fight then marry him in Haiti and file CR-1. It's still better than not having him with you at all.

To get married? I don't think you have to wait long. But if you want a nice wedding, you can plan it (as long as his work/visitor's visa doesn't expire) And after the marriage, you can apply for the spousal visa. Look at the Haiti portal for IR1/CR1 cases. But I saw that someone suggested you do some more research, maybe think about the marriage option after you've tried what she suggested! Good luck :)

we actually met 10 years ago via mutual friends, but we were just friends back then, then in 06, when i went to haiti on vaca, thats when we fell in love n we've been together since..

I mean - 6 years of relationship! That's an awful lot of time! I can't believe that their reason was to assume this relationship isn't real. You put pictures in there from the last 6 years, right? Or did he just bring them with him to the interview? Because if you put them in the petition already, how could they even doubt that this is not true love?!

I assume that it's maybe something else that's not quite right. Maybe the sponsoring wasn't enough for them. I just don't know how you can find that out. But before you go and fight you should find out what the reason for the denial was. Have your fiance scan the letter he got from the CO for you and look at it closely. Is there a number you can call? Google the matter and maybe send us the exact words again.

i did send a lot of proof with the petition, i mean, im still puzzled by it, so im gonna wait a few days, and do exactly what sammdt suggested...I pray to God that they will consider my inquiry.

Something seems to be missing here! As best I have researched, a K-1 Visa is not often denied. In fact, I have heard some state that a CO needs supervisor approval to actually deny a case. If your K-1 packet, as you have suggested, was very complete, and, you are confident that this is a genuine relationship, then I would speculate that something very grave was detected from your fiancé’s side of the perspective. How long have you both been communicating? As “Star” indicated this may be “Embassy Specific.” Sadly, you will have to wait to hear from USCIS before you know more about your situation. Don’t give up!

I still think it's the length of time that you guys have been together yet never married and then now doing only doing the fiance route, not the spousal route. Believe me, I'm not knocking it. I was engaged for 5 years (never ended up marrying, but that's a different story), so I'm not saying it's bad or wrong. I'm just thinking that the CO probably thinks that you are merely just helping a friend that you have known for quite some time to migrate to the US. Sucks that we have to go through all this bullcrap just to get our loved ones here, but, like I said, I think your best bet is to marry and file the CR-1. More time, more money. :( So sorry for your situation.

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

12/31/2012: Case number/IIN

12/31/2012: DS-3032 sent

01/08/2013: DS-3032 accepted

01/02/2013: AOS bill0

1/03/2013: AOS bill shows PAID

01/04/2013: AOS package sent

01/09/2013: IV bill

01/10/2013: IV bill shows PAID

01/11/2013: IV package sent

01/23/2013: Case complete

02/01/2013: Interview scheduled

US Embassy Lagos

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!
