At some point your going to have to come up with a birth certificate. The instructions for the I-130 says to include it so if you don't you will probably get a request for more information

not true. he does not need, at any point a copy of a birth certificate if he has a copy of his US passport.

Ok guy's I give up. When I DCF at Manila I was told I had to give them a copy of my birth certificate so they could verify my information on the G-325a but maybe that was only for my case or because I DCF here

The Birth Certificate of the Petitioner is needed only to document US Citizenship and is one of several options for doing so. However, a Consular Officer can ask for anything they consider relevant. This petitioner cannot use a US Birth Certificate to document US Citizenship because they were NOT born in the USA. If a Birth Certificate is ever asked for, it would have nothing to do with the I-130 filing and nothing to do with documenting US Citizenship.

Like I said, you win. I filed DCF and to do that in Manila you have to submit not only the I-130 but the G325a, along with a list that they give you, of other things you have to provide them with before they will even entertain you. The Consular Officer has nothing to do with it, it's the USCIS. I am only telling what they asked of me. It may have been different when you did your DCF. Things do seem to change from time to time but I just filed mine in December and have an interview date already. This will be my last post on this topic, have a good day, Dave

I do not like to give bad advise to anyone so would you please tell me what multiple mistakes I made so that I won't repeat them. Maybe the part about answering all questions asked, or about including a copy of the birth certificate and copy of the passport as per their instructions. The only person to mention passport number was you

I told you in my first reply but here it is again, as requested. You wrote commented on a post that said, "What does your BC say? Is it US or Phil? 1. So, yes check "3" and include the copy of your BC." by saying, "

This is the best advice I've read on this post. 2 Check 3 and enter you birth certificate, 3 it doesn't matter where it's from, 4. there are other places on the form that asks for your passport number. Always answer the question they ask no matter what it is period. "

I responded, "Unfortunately, no, this is not good advice. There is no place on the I-130 or any other form that asks for a birth certificate number. This question asks for certificate number for a "Certificate of Citizenship" which nobody actually needs and few would ever pursue. There are also no places on any forms that ask for the US Citizen's passport number, ever, anywhere."

I've made bold and numbered the multiple errors for the convenience of the reader. To be even more clear, I will address the incorrect statements in order. 1. The OP should check 3 and NO not just the third option. (Note there is no 3 to check. They check next to parents.) 2. followed by entering N/A instead of a certificate number. 3, it does matter where the birth certificate is from, because if not from the USA, it is not relevant to the question. 4. There are no other places on the I-130 or any other form, that ask for the US Citizen's passport number.

Nobody is saying anything about you "liking" to give bad advice but I stated clearly what the bad advice was in my first response. If it wasn't clear to you then, I hope it is now.

The OP is not filing DCF. Anybody can ask for anything. You gave them what they asked for so you have no idea what would have happened if you didn't have something available. Many of us here really do know our stuff. You might want to read and learn more before posting answers you're not sure of.

My mistake again, I've been back and forth with a guy on the DCF Forum that has the very same profile and name then. Try looking under DCF forum , DCF Manila Situation - Resident trying to file def , it's on page two. I don't doubt that many people here know their stuff but I also know that I was at the USCIS in Manila both in Dec. and in Jan. and know exactly what they asked of me.

This OP's profile clearly states their filing location is California Service Center. DCF is a different animal and far more rare these days. Check the actual profile information before posting. It will save you embarrassment.

I agree that his profile says California but he hasn't filed yet and if you would look at his post which I provided for you in the DCF Forums you will see that his intent is to DCF in Manila. This whole thing started because I told him what was required of me and assume they will ask the same from him when he gets here. Please read his post and then lets stop this.

If you would have read my message before replying you would have found the page. http://www.visajourney.com/forums/topic/414417-dcf-manila-situation-resident-trying-to-file-dcf/

Thanks for the link. He's not filing DCF. I could see that in his first paragraph. DCF is only available for US Citizens living abroad in a country that has a USCIS field office. Manila has one, but again the OP doesn't currently live in the P.I.

I agree, I tried to tell him that he would either have to come back here and wait to file or if he needed to work, stay in the US and just file there. Take care and have a nice day
