Applying for my green card from the UK before my UK visa ends

Hello,

I am Mauritian national currently residing in UK on a post study work visa which will expire in Feb 2014. My fiancé is a resident of the USA and we

will be getting married at the Registrar office in the UK in July 2013 and the religious ceremony will take place in March 2014 in India.

After getting the civil marriage done in July 2013, my fiancé will then file my green card application.

I have no intention of furthering my stay in the UK after my current visa expires and I am planning to go back to Mauritius in February 2014 to finalise the

religious ceremony arrangments

My concerns are:

1. Will it be an issue if my fiancé files for my green card application while I am still in the UK (after the civil marriage in July2013) and

what will happen if we do not get an answer before I go back to Mauritius?

2. In the the event I do not get the green card before going back to Mauritius, will I have to travel to the US to complete the application?

3. If I get the green card before february 2014, Will I need to travel to US first, before going to Mauritius?

I would be very grateful if anyone could advise me on the matter.

1. No it will not be an issue. what you would have done in the UK. is the civil marriage which you can use the certificate to file your petiton.

2. you have to indicate on your application that you plan to complete consular processing in Mauritius.

3. You have six months of grace after visa issuance to get into the United.States. So its upt to yu how many more counctries you want to visit, as long as you come in before the 6months validity expires. Mind you some countries start coundting their 6 months from date of medicals.

Side note: along the process, you will need to present police certificate from all countries you have lived in for more than six months since you turned 16years. so while in U.K , youshd make enquiries on how to get this certfificate when the time comes( unfortunately some of them have short expiry dates so you cant apply way in advance).

Is your fiance a US greencard holder or citizen? If a greencard holder it will take 2+ years for you to get a visa interview ater she files.

Usually; however, that is not always the case, that's why it's very important to check the expiration date on the visa and use it before then.
