Hi VJ's..

Just confused about the situations...am married now to my us citizen husband and no doubt that I'd used his surname..we just confusing about his surname if my two children is automatically use his surname, when they came down here at the u.s...some of my friends says it should be use his surname, because we got married already..and also my husband now knows that my children are automatically change their surname into his surname, and he puts all the surname of my children in his surname when we got change all his updated info in his work..is it true or we need to file an adoption paper for the legally process for using his surname..

Wow, I'm confused on this post but if the question is: can I use my husband's surname for my children who are from another father? The answer is no.

In my situation, where I've married someone who already had a child, the child is my step daughter and must remain with her full legal birth name unless we choose to legally change it or I choose to adopt her. I'm told both options are around the same cost but adoption may be a challenge even with the father's consent (which is required).

I haven't been through the process, but based on my research this is what I've found/been told.

The children will not use the surname of your husband, as they are not his biological kids.

Whatever names the children are using in their NSO birth certificate and Philippine passport, that's the name that they will use in all of their paperworks in the US.

Adoption is another thing.

The children's surname does not change after you are married. They continue to keep the surname of their actual, biological father.

am sorry i did not mentioned on my messages that am not married to their biological father and they used only my surname, also i did not put the name of their biological father on their birht certificate eversince i give birth to them..that's why my husband now insisting to use his surname when they came down here, because am not married to my ex and they not using their biological fathers surname..

More accurately children use their existing surname which may not be the father's if the couple was not married at the time the child was born.

yah we're not married of my ex which the father of my kids..and since they birth, i did not put on their birthcert the fathers name, instead i put NONE for the fathers name..that's why my husband now insisting,that they must use too his surname because they using only my surname since birth and now we are married he knows that my kids can use his surname too when they came down here at u.s....

my really plans are not to change my kids surname, to not to hard them when it times of their schooling here and not to hard them to write a new surname..i will explain it to my husband that they can't use his surname or we must file for adoption to use his surname..
