Really need help! Need Input ABout Tax Refund

Hello my fellow vj members,

Hope everyone is doing great. I have a question regarding tax refund. I need ur opinion,ideas if there is any of what is the best thing for me to do.

Here is the situation. I am getting ready to file for my income tax. Hubby is still unemployed for almost 4 yrs now. He talked to one of the IRS person and told him i can claim him as my dependent coz i am already a citizen and still he is not working. Now my questions are:

1. What is the benefit of me claiming him as my dependent?

2. We always filed married filing joint since 2007 and last income tax we filed married but separate for back child support issues and did not have issue when i applied for my citiznship.

3. I am planning to claim my 3 minor kids as well as my dependent + my husband (that makes it 4 dpendents).

Is this a good idea? if yes, why ?/and if no,,why?

4. How much should i get for each dependent? any estimate?

I would really appreciate all ur inputs.

OP, you can use turbotax deluxe, it's really good. And whatever you don't understand, their web support is super...

You cannot claim a spouse as a dependent. Go to IRS.gov and do a search for " injured spouse". You would file the following:

http://www.irs.gov/pub/irs-pdf/f8379.pdf

http://www.irs.gov/pub/irs-pdf/i8379.pdf

You may also be able to file an amended return along with form 8379 for the year you filed married filing separately.

Fill it out both ways for this year and choose whichever one gives you the greatest return. If you want to avoid the issue in the future, Reduce your withholding to the point you owe money to the IRS instead of a refund. You take home pay will increase, but you will owe The IRS the following year. Since you are wouldn't be getting a refund, the government could not garnish the return.

Hubby did not have income the last 4 yrs as he was not working. So can i still go ahead and do it? I am still confused on which is the best route for me to do/ Need a lil bit more clarification pls,. anyone?

Fill out your taxes both ways:

1). Married filing separately

2). Married filing jointly, with an injured spouse claim.

Whichever one gets you the greatest return, send it to the IRS.

If 2) gets you the greatest return, then file 1040X (amended return) as MFJ, with the injured spouse claim.
