Proof of marriage when living separately?

Here's my question. My fiance and I were just denied the K1 Visa for reasons out of our control (details are in another thread, and not something I want to spend time on now). We were advised by the officer to get married in Haiti and start over as a spouse visa.

My question is this: how do we prove our "ongoing marital union" when I will be returning to the U.S. (for school and such), and he will be remaining in Haiti? We have a lot of the documents required for the K1 visa such as phone logs, messages and emails, boarding passes (I've been to visit him three times in six months), my engagement ring, etc, but does that establish our marriage?

I can get affidavits from my niece, who has gone with me to Haiti twice, as well as from several family members of his. I can show medical records indicating that we're doing family planning (fertility treatments are in the forecast). We'll also have photos of the wedding and such. What else can we do?

I'm really heartbroken and a little defeated right now. I just want to be with this man, and it seems so unfair that such horrible and uncontrollable circumstances and the decision of someone behind a glass window, decides whether we can be together or not.

2012/09/14 - Called & insisted they fix THEIR mistake. Message forwarded to supervisor. Got an email within 30 minutes; fixed! Called & confirmed.
2012/09/19 - Still in AP (Administrative/Additional Processing)... waiting...

Timeline

Once you are married and file for spousal visa, you should have marriage certificate which is the big thing that shows you are married.

On top of it you should have wedding pictures and other thing like chat logs or phone call log to prove your ongoing relation.

Depends on the consular wht they might ask or what they might not ask, but for spousal visa you have your marriage certificate and that the biggest thing that proves you are married.

Most of us are proving our ongoing relationship while not physically being WITH our spouse. Affidavits from family members, emails, chat logs, text message logs, trips together, pictures etc etc etc. Lots of different ways to show you have an ongoing legitimate relationship.

Did you get married yet? To establish an ongoing marital relationship you would send much of the same, email, skype, boarding passes, receipts from honeymoon or trips your had together, joint bank accounts, pictures ect... There is a guide for I-130 at the top of this page.

If you're planning on getting married in Haiti, then the best way to establish the bona fide nature of your relationship is to show pictures, have affidavits signed by your closest relatives witnessing your wedding and give their opinion about your relationship. Also sharing financial resources would help (opening an account together after the wedding so you can prove complete trust in each other). Insurance, such as life insurance on your lives could help, though he would have to get his in his country of residence and you would have to get yours in your country of residence (usually). Ring receipts, wedding receipts, etc.. The previous documents that have already been submitted together. Family planning is a good thing, but the records should indicate both of you as having an interest in the fertility treatments (though I'm not sure if your medical records would ever indicate this - though perhaps you could use receipts from the visits to the doctor if your fiance paid for them), otherwise the IO might consider that you're undergoing the treatments with someone else or for some other reason. But it can't hurt to try to release this info to immigration.

Financial resources is important though. Essentially the old principle is this, "Where your treasure is, there is your heart also." People put their money where their hearts are. If you are truly trusting and loving of each other (in the mind of an immigration officer), then you should be able to get a joint account or life insurance policies covering each other, or other things which show that you have an bona fide financial interest in the other person's life.

Show whatever evidence that you can. Usually if there isn't enough evidence for an I-130 to be approved, they'll request exactly what they need, and you are given time to supply it.

I'm so sorry you were declined previously, but good luck to you on your wedding, marriage, and the CR-1 route you're planning to take!

Hello, I followed your first thread, and I just want to tell you that the only thing that is hendering you right now is what the consulate requested from you the first time. If you could provide a original death certificate of divorce papers that is recorded in Haiti National Archive you will have no problem. You will still need to show these documents anyway or else you will have the same problem. Do not worry if you begin to work on which ever document you think would be faster (death certificate or divorce papers) you would be with him no matter what. Good luck I will keep you guys in my prayers, stay positive and you will be ok. keep us informed
