What do you VJers think my chance is of being approved for an IR-1 visa before the end of July 2013?

My husband (USC) has filed the I-130 petition for me but it hasn't arrived at Chicago yet (its going via his mother's for a cheque). We have spent the last 4 years in Australia (with annual trips to the US). We were married in the USA 4 years ago and now have a tiny daughter. We are filing from Australia.

We have a wedding in which we are both involved on August 3rd (which could be considered a trivial reason to want to get there fast). Also, my husband's father has Parkinson's and is ailing. Once we get there, my husband has work lined up with him, so we want this to happen sooner rather than later.

It's unlikely your husband will receive his visa within 6 months, which is what obtaining it by July would entail.

~8 - 10 months is more realistic, although local offices do seem to be adjudicating immediate relative I-130s a little faster than the service centres were.

Hmmmm. I think it will be very tight too, and that its slightly unrealistic. But I notice that some people are approved so quickly, say in 4 or 5 months. How do they do that? What can I do to increase my chances?

Thanks so much Darnell. That is really useful info. I suppose you're saying to get things back to them as soon as they arrive so there is no wasted time. Its basically like having a full time job, this whole visa process!!

Im not entirely sure but maybe you could request and expedite? I heard people have tried it before but Im not sure of the outcomes. Check and see if thats possible and what the requirements are...I dont think a friends wedding is a good requirement but your father being sick and dying might be a good reason.

Our love began in 2010....our Journey in 2012 (January) and now we are at peace until 2014!

Timeline (kinda-- Im not putting exact dates- just months~)

--January 2012-- Sent our I-485 and I-130 packet off :)

--February 2012-- Touch-- Need more evidence.

--February 2012-- Sent more evidence.

--March 2012-- Biometrics and Doctors App (around the same time)

--June 2012-- (BIG PROBLEM) Immigration sent us a 'DENIAL' letter due to not having a sponsor (I thought we didnt need one)

--June 2012-- we hired a lawyer and got a sponsor, got the I-290B Motion to Appeal or Reopen had everything sent off by the end of July 2012.

--October 2012-- OUR APPEAL WAS APPROVED (breath easy, we didn't have to wait too long)

--October 2012-- Work permit sent-- got SSN

--November 26th, 2012-- AOS interview-- Got sent out told to get a translator and new interview date would be sent. :(

--January 8th, 2013-- Second interview...went well but no idea if we were approved or denied....VERY STRESSFUL!!

--January 15th, 2013-- APPPPPPRRRROOOOVVVEEEED!!!!!! (checked on USCIS web site)

--January 18th, 2013-- Card Production Ordered....welcome letter (hard copy) in the mail!!! :)

--January 24th, 2013--CARD IN HAND!!! DONE!!!!!

How do I know when Im allowed? Will they tell me? Or is it a better idea for me to do a K3? I just found out about that option.

The K3 visa is obsolete.I believe that route is also more costly. There are many people who expedite their I-130s, that may be an option you might want to consider but only if you qualify (there are specific qualifications). Otherwise, having the entire process be complete and arrival into the US by July when you JUST filed the I-130, it's unlikely.

monitor the NVC payment portal.

prior to that, use a telephone into NVC, get the casefile #.

What do you mean about the K3 being obsolete? Its on the USCIS website as a valid visa option, I think.

K-3 visas are rarely issued anymore, due to IR-1 / CR-1 visas being processed faster than they were a few years ago.

If you apply for a K-3 it will usually be administratively closed.
