Hello everyone i hope ya'll are enjoying your week-end.. but the main reason why im here is this thing been going in my head lately about Casablanca consulate ...i know it's a nightmare for Moroccan petitioners etc but im gonna keep it short and i would really apreciate it if i get some answers,, advise ,,help anything :) ........July 2010 i applyed for a tourist visa to visit my uncle for four weeks ,,i went through the interview and i cameback home they said because i've never been outside my coutry and im still a student a few months later i met someone we've been married since then but she couldn't stay here because it 's gonna be a challenge for her and her son to start a life here so we applyed and everything im expecting an interview in the next couple of months..I know how suspecious this may sound to a lot of ppl especially the consulate in Casablanca but is my previous rejection gonna affect my chances on getting my approval this time ??

You're married now? Where is your spouse?

If your spouse is in Morocco then it will help as that is a tie to your home country

What has changed since you applied last time (besides the marriage) have you traveled outside your country? Are you still a student?

Hello Thx for the reply,,i dropped out of college now and my wife is here with me she spent almost a year with me here our marriage 100% for real,, we are both 24 years old and we have all kind of prrofs to support this but still Casablanca is really hard to go through and the fraud rate is high comparing to other countries..and No i've never been outside my country before but my worries are only my previous application that might effect my current one ( k3 )

You aren't scrwed but it will be harder this time with a USC spouse than last time. I suggest you work on gettign strong ties to Morocco

Ties ?? But i applyed for k3 visa i thought all they need is proof of marriage no ties to my country.. and my case worker back in the US said i don't need none of that all we need is pics ,,e mails,,letters ,,passport stamps etc

Im sorry if i confused you but im a moroccan husband and my wife is a USC and SHE applyed for me to go live in the states

That would have been nice to post originally, I thought you were applying for another tourist visa.

When did your wife send the petition? Are there any red flags in your case (the quickness of your marraige...or did I misunderstand that too) is there an age difference? Major cultural differences?

You need to tell us your whole story, not just little bits and pieces

REd Flags ?? no not that i know of we have been married for almost two years now we dated for a year ,,we are both 24 years old we are both college students ,,the USCIS approved me June 2012 and we had to look for a sponsor because my wife (doesn't meet the income requirments ) we found one,,sent everything ,,paid everything,,, ,,no red flags no criminal records,,we know a lot about eachother even the tinyest lil details,, and she is currently living with me in Morocco right now ..as soon as we hear from the NVC i will post my visa status with the interview date..the only concern i had is me being rejected a tourist visa in the past and now here i am asking for a K3 ,,im just worry that's all.. and by the way Thanls a lot for taking time to answer my question ( Canadian_ wife ) .

You should not have a problem as result of the previous visa request as you were not trying to immigrate to the US, that does not change the fact that the denial rate for immigration visas out of Casa are very high. The only thing you have to do now is hope the CO accepts your sponsor, that he has a strong income record (noticed previously that they ask for sponsor's birth certificate) and you do well on your interview. Your wife living with you for a year is a plus. Did she bring her son to Morocco with her? That would make the case stronger as well. They will look at how long it took to profess your love, to ask her for marriage if done to quickly those are red flags it would be a good idea to include those key conversations when you go for your interview.

'' MIben '' I really apreciate the reply, and everything you've said seems reasonable and right in the same time,,my sponsor is my wifes sister her income is more than good she's been in her job for the past 12 years and she's financially doing Good,, But her birth certificate she included it with the sponsorship papers now what i dont get here is how CASA ask for papers that were already sent to the NVC ( sponsor birth certificate or the Affidavit I-864 ....) ,,Also she couldn't bring her son in the three visits to Morocco because he has school and it might affect her custidy and child support,, so she transfered custidy to her mom AND sister in order to come here 1st, 2nd , and 3rd visit

If the birth certificate has been asked for already then you should not have any issues there, I asked about the son because you said she lives there with you but if all she did was visit then yes I can see her not moving him. Most single mothers have issues with the fathers of their children when moving the children out of the state, country or if they no longer live with the custodial parent. If the father is ok with her family caring for the child while she moves overseas then I don't foresee any problems with those items.

To answer your question, no, a previous denial of a visitor visa will not affect your current petition. The one thing I will tell you, the k-3 visa is obsolete and rarely,if ever granted anymore. They will close that petition and process the i-130 for cr1 visa, assuming your wife filed an i-130 petition on your behalf.

Thank you very much,, yeah the father has no problem with this at all because he doesnt care or see or visit his son. all he does is paying the child support because the DNA test came out positive,,about the papers that were sent, birth certificate and affidavit what a relief i was worried that they might need them at the interview but i think the case worker did a good job by including everything in the first place.again thank you so much i was worried about that too :)
