Here is my situation: all paperwork is in order accept for the I-134. I am unsure how to fill it out and at what poverty level am I at. Everything has been going smooth until this last form. I have custody of both my children and the mother pays me child support. I can claim one child while she claims the other on taxes. I am worried that I don't meet the income guidelines I make around slightly under 21k not including support. If I include support slightly over 23k. Please help we are in final stages of paperwork and my fiancee is waiting to make the face to face interview for K1.

What's your current income before taxes? How many people are in your household? Aside form CAN or CANNOT.... Do you claim your children in your taxes?

Where is your fiancee from? Can you complete that information along with your timeline? That, will help us help you.

It does not matter who claims them on their taxes. All minor children are counted in your household size. You have a total household count of 4: you, your 2 kids and your fiancee. You need $28,812 for a household of 4. http://www.uscis.gov/files/form/i-864p.pdf

Child support can be counted. Include a copy of the court order plus check stubs or bank statements to prove how much child support you receive. That still makes you 5k short. You can use assets at 3 times the difference, so you would need at least $15k in assets.

You can contact the consulate in Bahrain and ask them if you need to show 100% or 125% of the poverty level for the affidavit of support. If they will approve financials at 100% for the I-134, even for K-1 applicants, then you would only need $23,050. It is worth a shot to ask first.

A co-sponsor can be any US citizen or legal permanent resident that meets the poverty guidelines for their own household size plus the foreign fiance(e). They will need to include proof of being a USC or LPR along with their I-134 and supporting financial documents.

You can list your mortgage, but you need to have an appraisal and show documents that prove how much you still owe in order to get the net value of the home. Also, the CO may not accept the value of the home since it would be a hardship to have to sell your house and have no place to live. It would not hurt to list it though.

have a few questions regarding the I-134 evidence and co-sponsorship. This is the last part that is holding us up from scheduling an interview so I need 100% accurate information. I have been stressing out over this since my job is not enough for the 4 of us.

Can I have more than 1 co-sponsor?

How many check stubs should be sent in?

Do I/co-sponsor need to send in previous year tax return?

If mortgages are owned do I/co-sponsor need to send that and what kind of statement should be sent?

Lastly, if something is still needed does immigration void everything and that is the end or?

I need to hurry on this since petition expires on 1/21/2013.....the embassy where she is living(Bahrain)is waiting on this info before they will schedule an interview.

How many check stubs should be sent in?

Do I/co-sponsor need to send in previous year tax return?

Yes, you should send at least last year's tax return, sending the last 3 might help in case they ask for them

If mortgages are owned do I/co-sponsor need to send that and what kind of statement should be sent?

Lastly, if something is still needed does immigration void everything and that is the end or?

They could deny it, but most probably they would put it under review and give you 60 days or so to send them more proof of your financials

I need to hurry on this since petition expires on 1/21/2013.....the embassy where she is living(Bahrain)is waiting on this info before they will schedule an interview.

You can contact the embassy telling them that you are working on putting all the documentation together and need more time and have them extend the petition

No. Only one person can be the co-sponsor with the I-134. They need to have enough for their own household size plus the foreign fiance(e).

How many check stubs should be sent in?

If the pay stub shows the year to date pay, then just the most recent one would work. Otherwise, 3-6 months.

Do I/co-sponsor need to send in previous year tax return?

You both need to provide at least your most recent tax return or IRS transcript.

If mortgages are owned do I/co-sponsor need to send that and what kind of statement should be sent?

You need to get an appraisal of the home and show your mortgage statement/loan information from the bank.

Lastly, if something is still needed does immigration void everything and that is the end or?

They could deny it, but most likely give you time to provide proof you can support her, or a co-sponsor that can.

I need to hurry on this since petition expires on 1/21/2013.....the embassy where she is living(Bahrain)is waiting on this info before they will schedule an interview.

Contact the consulate and ask if the petition can be extended. There is usually no problem in doing so.
