We are going to start the process for the CR-1 visa. I have lived in the States for 8 years with a green card through my US citizen husband, two years ago we came to Spain and we are still here. Because the economy is getting worse we have decided to go back to the US. Unfortunately I lost the privilege of being a permanent resident, I applied for a returning inmigrant visa at the Embassy but was denied, so the only thing we can do is start over. At least I can keep my SS#. Anyway, we got married in the States and a lawyer did all the paperwork so I'm totally lost this time, so I would appreciate any help.

First, I understand I have to send the form I-130, G-325 (mine and his),money order, passport pictures ,proof of bonafide marriage, I only have marriage certificate in the US, US daughter birth certificate and pictures .

My questions so far are:

1- Regarding proof of bonafide marriage : we got married in the US 12 years ago, do I need anything else ? should I send a copy of the taxes? we have a bank joint account, should I sent a proof of that? Do I have to translate to English?

2- in form 325-A, it says "Last occupation abroad" abroad of what, last occupation in the States or last occupation in Spain?

Thank you in advance

Answers:

1. Any evidence you feel that best proves your case should be submitted. Only official documents need to be translated.

2. Spain

Thanks.

Since I already have a NOA and SS # from my previous green card , will my process be faster? . I have read that take to 8-10 months and I would like to be in the US before September, I wouldn't like my daughter go to school once started. Is there anything I can do to expedite the process?

Read the NVC shortcut: http://www.visajourney.com/wiki/index.php/LingChe_NVC_ShortCut

It will shave a good deal of time off.

Also, current I-130s are being approved much more quickly than they were before. I would get in before that trend ceases to be the case.

There is a very good chance if you file now that you could be back in America during the summer.

3/2/18  E-filed N-400 under 5 year rule

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
