Hello VJ members I'm a little bit confused about something, I have no income so we got my mom as a joint sponsor and she used to work as a teacher and her income was very higher than what we need to be sponsored but she retired like 6 months ago and she is taking her retirement from the SC Public Employee Benefit Authority and she have a letter from them stating that she was a teacher and what was her salary and what is her retirement so can this be her employment letter? and can this retirement be counted as eligible income at all?... and currently she working part time job with a Company she started working with them like 5 months ago, so should she get a letter from them too? since she is gonna combine her retirement and Salary from the part time job to file the forms.

well she defintely cannot use her previous job income to qualify. As for her retirement income and her part time job how much it adds up to.

now on a personal note please dont take this the wrong way but if you have no income and your mom is coming out of retirement to work part time job what are your plans for supporting you and your spouse?

thank you for your answer, but I still don't know how to count that, cuz te last tax return was from her job as a teacher and this can qualify us, and for your note I think that wasn't my question

Only current and ongoing income counts. The best thing would be for your mom to file taxes as soon as she can in 2013, that way she will be able to submit a current tax return with her retirement and part time income listed. If that is not possible, just submit paystubs from the part time job (and ideally a letter from the employer saying the job is ongoing, not just a Christmas thing), and a retirement income statement. Bank statements from the last few months, showing the retirement and part time income going into the account, would be useful too.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I would strongly recommend that you find yourself a sponsor with a current job who qualify. Your mom has too many baggage. First of all immigration want to see a history of employment and income. They are focusing on the latest year of employment income. Usually its a touch and go when the sponsor have started a new job and produce income from that. So if you have another person as co sponsor they must qualify in everything. If you don't get this sorted out now, your wife will be given the refusal worksheet (221g) and would be ask to get a sponsor when she go for her interview. So I strongly advise getting the right person who qualify from now.

1. Make sure whatever income she is showing its above 18k but that also depends on the household size etc

2. What matter the most is what you are CURRENTLY making. Your past tax returns gives an idea of how well you were before financially. It gives them an overview of your financial background

3. You can combine her income with another household member and then have that member fill out I-864A as well. This way both will share liability

Thank you Guys for sharing your valuable information with me. I talked to a lawyer today and she told me that all my mom need to file the affidavit is her last three tax returns and W2 for the last three years and copy of her passport that's all and I think we can make it with that and when I ask her does she need bank statement or letter from her employer as they said she MUST include that on the official website, she told me not to trust these websites and just to send what she told me about and we should be okay as once they see that the tax returns cover the requirements they don't care about anything else...... do you think that's right???

Hey Amanda! :) Noooo, I think that's very bad info they gave you. She needs to show CURRENT income. The last 3 years of tax returns doesn't mean much if the current income isn't there. The tax returns are to show what your Mom has been bringing in...to show whether or not the income is steady. But the current income is what's most important, as that is what will be supporting your husband.

And it does not say on the website that you MUST submit employment letters/pay stubs. That is optional and used to verify the CURRENT INCOME.

You should submit the last 3 years tax returns and W-2's (or tax transcripts only)...and because your Mom is relying on retirement and the part time job, she should include as much evidence as she can that shows her current income. Her retirement info, plus paystubs/an employment letter from the part-time employer would be nice. The evidence is optional, but given your mom's situation, the more you can show the better. And don't talk to that particular lawyer again LOL :)

Oh, and have you looked at the I-864? I suggest you look over it very well and read the instructions for it also. I think it will answer a lot of your questions. You'll see where on the I-864 is asks for the current income...in addition to the income tax totals.

If your Mom's current income is substantially different than what her last 3 tax returns show...you should be ready to explain why. That's where the retirement info/paystubs/employment letter will come into play. You don't want to make it to the interview then have the CO question why the totals are different and then give you a paper saying you need to submit additional evidence...or worse, find a new sponsor!
