Hubby got an RFE for my Birth Certificate. :(

Both the Guide and the I-130 Instructions are the same and say it's not required but Charleston wants it.

Luckily I had ordered my long form BC to have it ready for future need so I'm good to go there.

Hubby wants to know if a scanned and printed copy is good enough (I really, really do not want to send my only original) and what should he include with the BC? I was thinking he needed to include a copy of the RFE, but does he need a cover letter?

On a happy note, at least it's been looked at. :)

well which guide says its not needed??? Bcoz its mandatory at all stages of the process. At USCIS stage copy is OK. keep original for NVC stage.

and yea you just filed in September so this is great news. once you send that in you should get approval within 2 weeks.

Also, the I-130 instructions do not list the immigrant's birth certificate.

I had fully expected it for later in the process. I'm just glad I ordered it early.

We also didn't send it, because it was not asked for. We did, however, send a copy of the bio page of his (immigrant's) passport. We've just ordered a copy of his birth certificate with English translation for the NVC stage. I hope we didn't mess it up! Our I-129F was approved without his birth certificate as well. :whistle:

I didn't send my husband's.

There were a couple pages copied from his passport though because I sent as proof of relationship.

This included the pictures page. Is that the bio page? It says place of birth on it as brantford, CAN so I assume yes?

Hope I don't get an RFE =[

This is the second thread now I've seen where someone got an RFE for the beneficiary's BC so I'm wondering if it's worth UNcrossing on the checklist page...

I just re-read the I-130 instructions from USCIS. It stated that you needed a copy of the petitioner's birth certificate or passport, but not the beneficiary's.

Maybe the person processing it is not aware of the requirements?

Yup I read them too, twice. Never saw anything that says it.

Well, I hope mine will inadvertently count if someone decides they can't remember the current requirements.

Though the scan is very small because I was only trying to scan the stamps as proof =\

I am thinking that the Field Offices may be using older manuals or the personnel aren't aware of changes that have been made. They were specific in the RFE that the BC had to include my parents' names so they are looking for more than proof of citizenship.

I hope that the other people sent to Field Offices have better luck and no RFEs.

Well I'm at the NBC so let's hope they have the up to date info since they're new.

I'm seeing other California Service Centers with submission right at the time you did getting NOA2s now.

I would think, given those statistics, that you would have gotten an RFE already.

Hopefully you will have your approval soon!

No, our case hasn't shown any change in the case status screen since the transfer to the Field Office.

Let's keep our fingers crossed that it's just the one agent!
