Hello!!

I am the USC and am living in Brazil with my husband. I will not be able to use my current income since it will end when we move to the states. When it is time to file the I864 we should have enough assets (3x 125% poverty for 2).

We have co-mingled most accounts since we married all my savings accounts now have his name on them. Will this be a problem? Will all of our savings count toward the assets or will they be divided in some way? Will we still be required only the 3x or will some of it be calculated at 5x?

You can use your assets as a family. The fact that they are in both your names is a good thing.

If assets are sufficient, there is no need for a joint sponsor. Yes, the couple's liquid assets can be used to qualify. However, it's best if the totals are comfortably more than three times the income requirement.

Thanks all! I could find a joint sponsor, but it is not something I want to do at this point. I don't want to burden my family with the responsibility. So I am saving as much as I can and will file the 864 when we have the magic number. It looks like it will be right around the time of NVC. Let's see what happens :)

Yes co-mingling is a good thing, but you should really be comfortably over the x3 limit when doing only assets, not "just about there by NVC stage". Are the assets US based or in Brazil? Not sure about that specific US embassy but many will not accept foreign based assets, or will only accept them on a x5 level, whereas they take US based assets at x3.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

In February (earliest we will get NoA2), we will not be comfortably over the 3x, we will be just over it. By the time we have our interview, we will be comfortably over the 3x.

Do you think that NVC would flat out deny us or send an RFE if we are just over the 3x at NVC filing?

All assets are in the US or can be there easily through wire transfer.

Just an update....we had our interview in Rio and they would not accept our assets even though they are well over the 3x. The consul implied that no amount would be satisfactory and we were required to get a joint/co-sponsor since I work in Brazil and have no US income. So joint sponsor it is! Papers are on their way :) thanks again everyone for the guidance.

I know! I was hoping this wouldn't happen, but it is what it is. I can appreciate that they want to avoid a public charge. I also asked if I could go back to the states and get a job and resubmit my 864 in a couple of months with pay stubs. She said I would need to wait a year or until I filed taxes that showed the magic number. She was nice, but very adament about the joint sponsor.
