Can I travel internally on an expired 1-94?

I came over in August on a K1 visa, got married in August then started to settle the family in. I'm finally getting round to filing for AOS, I didn't realise my i-94 had an expiry date (there really should be a "Next Steps" issued by USCIS...) and it expired last week. Reading up tells me I am now "out of status".

Am I still able to fly internally with just my passport and marriage certificate?

You can travel anywhere you like but you will be considered to have abandoned your AOS if you leave prior to obtaining AP or your green card and you will have to start all over with a CR-1 visa to immigrate to the US. All the I-94 is, is a record of your entry into the US and how long you are permitted to stay.

Oh sorry, missed the internally part. Yes, you can travel within the US no problem, you just need a photo ID.

Yes you can travel but be wary of checkpoints because being married does NOT protect you from being detained by ICE for being out-of-status. You are still at risk of being locked in immigration detention while you await a hearing before an immigration judge (unless you post bail which in some cases is very high) at which point the judge with order you to AOS asap.

You would be best, imo, to wait to travel until you have filed AOS and have the NOA1. Then you have proof. Sometimes ICE will still detain you (has happened before) but you're "safe" from deportation until your AOS is adjudicated.

I'll be flying NC to NYC. By then my AOS application will be in and I should have my NOA1 also.
