Hey,

You will be in trouble with the law if you try to marry another woman before your divorce is finalized. And in Ghana you have to show proof of termination of previous marriages which.Without that you cannot even marry her.

You can use this trip as your first visit and see if you really think she can be your future wife and it is a nice start to show uscis that you have seen her an you went back to marry her on another trip.

Relax...you will be fine.you are so excited now

I am going through divorce now and it will be finalized in January 2013 but I've already met a lady in Africa that i want to marry and i told her i am coming in December( i already have my tickets) this year so that we can go to court to register our marriage.Now my problem is will be a problem if i file with my new marriage certificate with the USCIS since the date of my new marriage will be before my final divorce decree? Please someone help me

You can't marry if you haven't divorce yet; however, the fastest way is to get a BIFURCATION from the court. Bifurcation restores your single status and allows you to marry while you are disputing with your ex-wife.

What is i file for a fiancee visa for her after the divorce?

You can file for K1 (fiancee visa) after you have restored your single status. I filed 2 weeks after I got my single status. NVC approved me (NOA 2) in less than 3 months. CA is a no-fault state so it is very easy for me.

Are you american or a green card holder?

First of all if you are a green card holder you can't bring her to USA with K1 visa.

If you are a Green card holder she can file for F2A , she has to wait outside of the USA at least 3 to 4 years until a visa number becomes available, but if you are american then she can file CR1 visa, it takes around 1 year to have the CR1 adjudicated and the visa issued.

You can't get married with someone before having your divorce FINALIZED.

It's not prohibited to get divorce and right away to get married with another woman, but do they think is ok? hell no.Good luck

In this case what if she comes in here as a fiancee?

They will deny your petition for a fiancee visa because you aren't free to marry.

You and your fiancé(e) must be free to marry. This means that both of you are unmarried, or that any previous marriages have ended through divorce, annulment or death. (straight from the k-1 visa guide)

In California there is a 6 month wait from filing to final judgement. I assume you mean you waited 2 weeks after the final judgement ?

This will not be over quickly. You will not enjoy this.
