If i am denied my right to have a visa and marry my fiance, is there a law that the consulate will have broken? and if possible is it ok to take them to courts of laws in the USA and compensate for the stress and the long wait they have placed on our happiness?

I don't think there is any legal recourse for those denied visas.

But take heart, Kasoma.

We've all been there in the long, frustrating process and unbearable separations. But you will see so many success stories on these forums. Yes, it took a long time. It was a hard fight, expensive, very stressful, and not a few tears. But once you get the paperwork and you are together in the states and building a life together, it will be worth it.

Immigration is a priveledge not a right....They aren't stopping you from getting married ,they are only stopping you from entering the US till you meet their requirements.

You do not have a right to a visa. No one is stopping you from marrying your fiance. The consulate will have broken no laws if you are denied.

No, you cannot take them to court for decisions YOU made. If you didn't want to wait long, then your fiance should move to your country. USCIS is not concerned about YOUR happiness.

Not to sound cruel, but the US government doesn't owe you anything and you have no right to anything regarding immigration
