Question 22 on the i-130 form..

Im the beneficiary, in the UK, It says:

"Complete the information below if your relative is in the United States"

"Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in":

[city] [state]

"It then says, if your relative is not eligible for adjustment of status he or she will apply for a Visa abroad at the American Consular post in":

[city] [country]

If im not in the USA then i presume my wife fills in the city and country i want to apply for my visa at ? ie London, England ?

Only reason im asking is both these sentences are under the:

"Complete the information below if your relative is in the United States"

Both of those boxes should be completed as "N/A" if your spouse is not filing for adjustment of status.

Incorrect

If your spouse is not adjusting status then you'll fill out the part that says

if your relative is not eligible for adjustment of status he or she will apply for a Visa abroad at the American Consular post in":

[city] [country]

List the city and country of the consulate

There's a left side, and a right side..

The left side is for Adjustment of status, the right side is for interviewing at a Embassy for a Visa.

As with other people, I disagree with your interpretation. The key with USCIS forms is to interpret literally.

Q.22 on the I-130 states "Complete the information below if your relative is in the United States and will apply for adjustment of status". It does not say "below left" (or "below right" for that matter), it says "below", so this question is intended for in-country AoS applicants only.

This has been a question that's consistently pulled in a variety of answers from the VJ community. My hubby and I are also in the UK. I chose to put N/A for all areas of that question, as I kept going back to the bold heading. My I-130 is still being processed, so unfortunately, I can't let you know if that was correct or incorrect.

The form is incorrectly formatted, but you do indicate the city of the Embassy or Consulate for a visa case. Really. Take it to the bank.
