@GreenTrain: sorry to hear you are still waiting and waiting...but don't lose hope, have faith! You're over the biggest steps...sending off the package, waiting and dreading to get RFE, then checking the mailbox every now and then to see if you got biometrics appointment letter, then do that, then see if you still can get RFE, or whether you'll ever get your EAD card....then finally you get your EAD card...then again, thinking are you going to get RFE....are you going to get sometimes the interview appointment letter...then finally comes the interview appointment letter. Then you're a nervous wreck of how hte interview going to be....are they going to tell you straight in the face that "sorry, you're nothing but a scam! You're denied!". Then finally the day comes, and the interview goes well, and got approved. You're only missing the last part of the "game" the actual card. So, I think if you look back you've come a long way! :) And you're totally at the right track, and done all that and gone through it all. So don't lose faith now! Maybe they actually just put aside your case, and "forgot" about it...then sooner or later they will be like "oops" and you find your card in the mail. :) Seeing your on H1B visa also tells me that you, indeed, have come a long way! You've worked hard to be able to get a job here! You've shown people that you're worth to be here, hence they gave you H1B visa. If you got your H1B through F1 after finishing school and your OPT then it even shows how long you've come from. :) So, don't lose faith! In no time you'll be getting your residency adjusted and you'll look back and say "Heck! It was worth waiting! If I had to wait for another 5 months, I'd do it in a heart beat!" :) All the best, and let me know when you get your green card. I want to cheer for you (or rather, your card...but that sounds odd...haha!). :)

Coming here on H1B is purely depend on one's qualifications/merits, and then getting green card depend upon relationship, red tape & of course luck.

People like me never lose hope just because people like you are always around !! :thumbs:

I'll complete this whatever it takes. Definitely we'll cheer when my card arrives

Hey Coolmind: I live near Sacramento, hence everything was done in Sacramento. But I'm only F1-->GC. No H1B. But GreenTrain is H1B (but no F1 prior). I want to say he was also in Sacramento, but I may be psychologically making that up...:o)

Hey Coolmind: Yes, I did hear LA is a bit slower...I think it has to do with the population....LA itself is already large enough, hence the number of applicants are significantly higher...I am in an area where very few people live to start out with, and hence the number of applicants are like 1%. So they shove these 1% to one of the USCIS office in Sacramento (there's more than one, split up by counties) and hence I've got my EAD in a month, and my green card in three months from the date I submitted my AOS package. And my interview was more than ridiculous....besides the IO looking at the photo album and asking us how long we have known each other (since 2007) she did not ask for our joint bank account, lease agreement, bill payments, insurance (car and health) or anything like that. I went there with a backpack and all I had to pull out was the photo album, my DL and my hubby's DL, and my passport to show what visa I was on at that time. That was it. It was quick...I know, poor GreenTrain is having a bit of difficulty but I know he'll win his case in no time! :) Good luck to you as well! :)

I just moved to LA bcz of new job.they filed my h1b and i got notice of action but its still pending. that shouldnt be an issue rght?

also, As I just moved, I still have Illinois drive license.and my wife has NJ's driving license. never got chance in IL (or in CA) to get the license. but now we'll do that within 1-2 weeks

so do they check the date of issuing the driver's license? we live together since we got married.

Hey Coolmind: I think the fact that you just got your "approval" to H1B from your employer so that you could switch from F1 to H1B while now sent off AOS package I don't think will cause issues. The only think you have to keep in mind, that if say you get denied for green card for some reason then your H1B petition cannot be used anymore as it will be canceled as soon as you'll file your AOS package and they get it. They will cancel the H1B petition and the whole process, and if you are denied for GC you cannot use this anymore. If you are no longer a full time student on F1 visa (which sounds you aren't) then that means you'll be out of status, hence you'll have to leave the country. But I don't write this to scare you, I think most people get their GC when they file AOS as their spouse is a USC. However, until you don't get your EAD you won't be able to work for this company that petitioned your H1B visa as that one did not get approved, and you are already abandoning the application by filing for immigration. So you'll have to wait until you get your EAD in order to work for this company. Anyone, correct me if I'm wrong, I'm not fully sure, but this is what I have gathered by reading this site in the last couple of months...good luck!

thanks for your concern. I apologize for not mentioning the entire info. I already had H-1B in my prev company, and got new job. so transferring my h1-b. I have Visa stamping and I'm all set till end of 2014. :)

Also, while writing you this reply first thing in the morning from work, I checked my h1 status and it is saying that

"On January 4, 2013, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
