I-751 advise needed

I sent in my first I-751 application in September and no check was cashed and an NOA1 was never received.

I was advised to cancel this check and send another application. I sent it signed for delivery and even have Dan Renaud signature confirming delivery of the application.

I waited the standard 30 days called back and basically got told that this application has not been received either and the check has not been cashed. (I have double checked with my bank and checked I made it payable to the correct name and the amount was correct)

I also triple checked that my application was completed correctly.

All I got from two different telephone representatives from USCIS is sympathy and that they cant do anything it is my responsibility to have the application delivered (which I already know it has been) and they gave me an email for Vermont to send my concerns to.

I emailed and got a reply stating they will respond within 15 days. Which will be 2 weeks before my green card expires.

So what should I do send another application? Cancel my second check and send another one or send a money order? Should I send it USPS signed for or a courier?

I am about ready to drive over and hand the deliver the package.

Any good advice will be much appreciated

How long have you waited? It took at least a month for the check to be cashed when I filed in May. How long did you wait on the first check?

On the first check is was about three weeks and then the second check has been over a month

Also my bank has confirmed that neither check has been presented

Yeah, if you look at the monthly filing reports, that seems normal. I wouldn't have cancelled the first one; that might make more problems for you now. Do you know where the monthly filing reports are?

Okay, I checked the newer filing reports and they have been coming in faster, but I waited almost 5 weeks for a NOA1. It can take up to a month, and since Vermont is taking 9 months to complete the ROC, I would be waiting patiently.

I know but the USCIS customer service are even saying that it sounds like my file has not been received if it has been this long.

Did you call when you hadn't heard back after 30 days?

Please can you send me the link for the filing reports

Yes my expiration date is 3rd December 2012

I will be happy once I get my NOA1 extension letter they can take all the time they want then

Im just worried that if I don't present this soon to my employer and college I wont be able to continue

USCIS customer is service is the "misinformation line." I would try an Ombudsman or something. Are they the ones who told you to cancel and resend after only 3 weeks? That is bad advice.

I didn't send the 1st with any delivery confirmation or signature so I take full responsibility but it was bad advice at least I now have a delivery signature on the 2nd application

Did you chase after 30 days?

I have the same issue. I see folks who FedEx packages get the NOA in a few days. It seems like USPS mailed packages go into a black hole.

Timeline

Ok, here is what you need to do:

wait for Vermont to respond back, if they responded back saying they did not receive it, then you need to reply with the delivery confirmation showing the signature of the person within USCIS who received it.

This way you prove it was delivered no doubt and its their responsibility to find it.
