I was just wondering.. Coz the County clerks office here in LA keeps on telling me to wait for that damn 2 months before we get our marriage certificate!!!!! And if that will be the case, it will turn out filing my AOS just 2 or 1 week before my 90 day countdown ends!! So Im kind of thinking of submitting the CUSTOMER COPY of our marriage certificate instead.. If we'll be having an RFE (which I hope not though it is likely) I will still have my EAD papers filed and moving though.. My priority right now is to be able to work to fight off homesickness and of course to help hubby with the finances.. I wish we just chose to get married in Las Vegas. :/

And one more thing... how long would an RFE slow down the process of AOS? will it be like 30 days?

Thanks.. :(

Is the customer copy a certified copy? If so, you can just use that.

Nothing 'bad' happens when your "90 day countdown" on your k1 stamp ends. So its basically up to you. You can send in your AOS packet with your 'customer copy' of your marriage certificate (if its not a certified copy you will get RFE'd- it will slow you down- how slow? I dunno, maybe 30 days? maybe 60. You have to figure they send the notice they give you time to reply, you send it back, they look it over and then start processing it again) But yes it would get your EAD application going- so the choice is yours...

In the case of having the EAD processed, once an RFE is sent out that'll be on hold also until the RFE is fulfilled. I say this because this what i'm going through right now, i received an RFE on OCT 22nd and it said that once they receive the requested information they'll continue to process the I-765 (EAD) so until they receive it my case would be on hold. Sry if this applies to you, but its encouragement to get the requested taken cared of faster.
