Hi there,

So i am currently in the I-130 stage of the IR-1 Visa, my petition is still at the initial review. Now, I obviously want to get down to the states to be with my husband ASAP. I am wondering if it is possible to apply for a work visa while in the IR-1 process so that I can go live down there with him and work? I know Canadians can stay in the states for 6 months anyway, so I can't see that being an issue...or would this totally mess by the IR-1 Visa? I'm not sure if I have to stay living in Canada through the whole IR-1 process.

(USCIS/NVC letters took an average of 50 calendar days to arrive in the Philippines so we don't rely on letters, thanks God for internet and VJ)

It would be possible to apply but the visa would be denied. In reality, the USA doesn't really have a "work visa" that individuals apply for other than for nannies, or student work study anyway. Other work visas are employer sponsored. Either way, people with immigrant intent are ineligible for non-immigrant visas. Chances are you can visit often or for several months if you haven't abused the Canada visitor privilege but you will not be authorized to work.

Keep in mind many work visas also take months to get, by which time your CR-1 will be done.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
