Hi Sorry i posted question already but now cant find it, Sorry....... I was married in June, Aos in October and new job On October 31st ...... when it come to tax time does my WIfe (sponsor) put me as a dependent for the 5 months or do we claim jointly as married couple ? .... Thanks looked around forums but cant find appropriate answer

AOS - 07/31/2012 - 2months 18 days

Process from filing 129-f to AOS approval 349 Days

Married filing jointly, even if you were married on 31st December.

A spouse is never a dependent.

Married filing either jointly or separately is the way to go unless you guys meet the guidelines for filing head of household, then that would also be an option. Do you have kids? Did you work this year?

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved

YOU ARE NEVER A DEPENDENT OF YOUR WIFE!!!! NEVER!!!

Your wife has two choices if she has no children; file as married filing separately or married filing jointly.

Married filing separately means she needs nothing from you. You are not considered.

Married filing jointly means you join in filing with her. You are not her dependent. The two of you would be filing together. You would need an ITIN or SSN. You would also need to voluntarily elect to be taxed as a US taxpayer. This means you must declare the income from your country and it is subject to US taxation.

Your wife cannot file as single. She is not single.

Well my wife has 2 so I have 2 stepchildren and I start work Tomorrow

Im not sure on head of household as I start tomorrow but then I will be earning a lot more than my wife,,,,,, Thanks maybe i will google that
