Fiance vs. Spouse visa

Can please someone explain to me why fiance visa is way more faster than spouse visa? It seems like fiance visa can get their interview schedule after they got their Manila case#. Do spouse visa really need to complete the NVC stage for us to get our interview date schedule? I'm on my NVC stage and I have my case # already. But I guess we still need to go through some process just for me to get an interview date. :(

I just wish that i'll be able spend Christmas with my husband! :( :( :(

I will try to say this politely without making waves on here because this issue comes up in threads. The K1 is not meant as a trial. Unfortunately some men go to Phils once get married and the girl has no idea what she is getting into and the guy can care a less about the Phils. In some ways I believe is good for her to come on K1. For me I spent alot of time with her and family and friends and we did K1 but now going through AOS. We were fortunate in quick process. Hindsight, wish I got married there and did CR1. The processes are different because of the requirements, each have there benefits and disadvantages. From what the experiences I have read on here and what everyone goes through The K1 is the route to go so I hope no one gets hurt or treated bad especially for the the beautiful and loving Filipina you committed to.

It doesn't take that much longer, and with the spousal visa, you get a greencard upon entry, whereas with the K1 you need to file more paperwork and wait longer till you can work and travel.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Don't fret, you'll be together soon. It's all part of the process. I think it's not really an "absolute truth" that K1s are processed faster than spousal visas, sometimes it's the other way around, it's a case to case basis. Plus, there are pros and cons, some of which are stated above, according to which process would work for you best.

My friend did the K1 visa because that worked for them. My husband and I could have done the K1 route, but we chose not too. Being that I am the youngest in the family and from a very traditional closely-knit family, a wedding here in the Philippines was preferred. I guess since my husband is also Filipino, he also wanted to have our wedding here and be traditional. But when we decided on that, we knew and accepted that it might take a while before we can finally be together, for good.

I have visited him a couple of times before we got married, spent 3 months with him after the wedding. But still, despite those visits, I was not that accustomed yet to the thought that I will be moving. I guess this happens when you are already in your 30s, lived your entire life in just 1 country, with your family and never really thought of living abroad as things are going great for you in your home country. Now, I am using the "waiting time" in preparing myself emotionally for the big move because I know it's going to bring such a big change. It's been almost a year since we were last together, we didn't spend our first anniversary together, this will be our 2nd Christmas apart - but we're doing just fine. He is using the time to prepare for my move, we are in constant communication not dwelling on how long we've been apart, I am using the time to take care of things here before I finally leave, prepare and research on target job applications, etc. I am spending more quality time with my mom & family, because I know I will miss them so much. Sometimes when I think about my move next year, I cry, lol! My husband completely understands though. To tell you the truth, we feel like we're almost there and it seems like time is just flying by!

Don't wait too much. You could try to focus on other things while waiting, before you know it, it's time for you to book that flight to the US! :)

From the date of case complete, the interview is USUALLY...about 6 weeks after that date.

Fiancee visas require adjustment of status before permanent resident status is granted. Immigrant spouse visas do not. The difference in time is a matter of weeks. The answer is really irrelevant though. Married people get spouse visas, not fiancee visas.

Facts are cheap...knowing how to use them is precious...

Fiancée Visa, CR1 and IR1 all area bit different. There was a time that Fiancée Visa's were much faster then CR-1 and IR-1 (spousal) Visa's. That has changed and should have! Now there really is not much difference in the time frames. A person married should not be penalized with longer time frames for a Visa then a person not yet married. As I have petitioned for several years through Congress and Federal politicians to have this changed. A USC married should alway have priority over a pending marriage!

Changes have been made. Now a CR-1 and a IR-1 can be adjudicated in less the 90 to 120 days if all paperwork is properly completed and accurate. Now I would say the average is about 180 days, but that is more because the petitioner or applicant does not have their documentation ready prior to filing. It's all about doing your homework.......stay a step ahead of the process.

Fiancée Visa come with conditions and no guarantees the marriage will work, as noted in many posts here! Additional cost will be incurred for AOS. CR-1, married less then two years has conditions, again AOS has to be done, 2 year green card. Both include additional costs stateside and limited green card (2 year) status. IR-1, married over 2 years by far is the cheapest (no AOS), 10 year green card upon entry, SSAN with in 2 weeks to include all working privileges. But to me most important is the fact that you have been married over two years and chances of her leaving you are greatly reduced.

Call me callused if you wish, but this one visit (2 or 3 weeks) and bring her to America is a real ####### shoot! Think about it, would you do the same with a woman or man in you home country.........date them 2 weeks, talk on line for a few months and then spend a few thousand dollars and a commitment to marriage? I doubt it! Sorry I do not have a lot of sympathy for you!

I have lived here for almost 4 years and been married for over 3 years. Only in the past few months have we talked about going to America. Over the last few years we have become friends.......not lust........not even mushy stuff......we care for each other and love each other....she knows me.....and I know her........she knows I'm not perfect and I know she is not as well........it's a partnership based on trust and commitment...love. So we decided to go for it, together.......and for all you out there wondering, yes there is a 32 year age difference.......I'm young for my age and she is old for hers.......worked out perfectly!

We flew up to Manila (from Davao City Mindanao) and filed my I-130 (DFC) on Oct 2nd......we were approved and sent to NVC 14 days later. As it looks now, considering I have all my paper work and documents done (interview ready)it may only take less then 90 days to complete the process barring any unforeseen misfortunes. So I say to you, if your gonna do this, then do your homework and have all your documents ready prior to filing and you will be surprised how fast it can happen.

If you need my help sent me an email...........I'm here for you if you need me. I only ask one thing, make sure you are thinking with the right head! Trust me.......I will know if your not!

If the petitioner lives in the PI and files DCF, the spouse visa is much faster than the fiancee visa process but that's really comparing apples and oranges. Fiancee visas cannot be processed DCF anywhere.

EAD never comes into play in spousal visa cases. Additionally, AOS for a spouse visa case will mean Affidavit of Support.
