Good Morning,

I would like to know what steps I need to start in order to bring my step daughter her to live with us in the US. Can I file for her since she is my step daughter? What forms do I need to complete? I assume the I-130 and the G-325A.

Any help would be great and Thanks

01/06/2012- Married My best friend

05/09/2012- Mailed I-130 via Fed Ex

5/10/2012- I-130 has been received & Signed for at the Chicago lockbox at 10:23 am

05/14/2012- Received NOA1 via Text Message

05/17/2012- Received NOA1 via Snail Mail(Postmarked 5/15/2012)

07/27/2012- 9:36 am Received NOA2 via text message (thought it was a dream)

07/30/2012- Started calling the NVC to see if case has been received

08/02/2012 -Called NVC- Rep told me that NVC Received Package 07/30/2012 (Still no case# assigned)

08/16/2012 -Called NVC- Information has been entered and received my case number (Yahooo)

08/24/2012- AOS Bill invoiced and paid

08/30/2012- Emailed the DS-3023

09/05/2012- Sent AOS (Affidavit of support) packet via Fed Ex (overnight)

09/06/2012- AOS Packet received

09/11/2012- Received email notification that the DS-3023 (Choice of Agent) has been accepted

09/13/2012- Received IV Bill

09/13/2012- Paid IV Bill

09/17/2012- IV marked as paid

09/17/2012- Sent IV Package (DS-230) via Fed Ex

09/18/2012- IV Package Received

09/18/2012- AOS Packet Accepted

09/25/2012- Called NVC and found out I have an RFE

09/26/2012- Received RFE via EMAIL

10/01/2012- Sent original divorce documentation (RFE) via Fed Ex overnight

10/15/2012- CASE COMPLETE (Yahoooooooooooo)

10/23/2012- Case complete email received..

11/02/2012- Called DOS and received interview date

11/05/2012- Received email with check list and appointment date

11/20/2012- Medical Completed

12/03/2012- Interview Scheduled

12/24/2012- Entered the USA and got to MN at 12:08 am on 12/25/2012 Merry X-Mas to us

If she is under 18 there is no problem. You just go about it the same way you did for your spouse, more or less.... Instead of sending in proof or relationship and stuff make sure the girl has a correct birth certificate and some kind if paper where it states that the parent bringing the child either has sole custody or that the parent staying behind gives its consent.

YOU HAVE TO FILE I-130 YOU HAVE TO SENT IN THE 1-130 FORM, THE PROOF OF CITIZEN FOR YOURSELF, AND THE MARRIAGE LICENSE AND WAIT FOR IT TO BE APPROVED AND YOU WOULD GO THROUGH THE SAME PROCESS LIKE YOUR HUSBAND DID.AT THE INTERVIEW THE CHILD'S MOM HAS TO BE THERE TO SIGN A CONSENT FOR HER CHILD TO MOVE TO THE STATE WITH YOU AND YOUR HUSBAND. THE QUICK WAY: HE CAN ADD HER ON TO HIS CURRENT D-230 FORM AND SHE CAN COME WITH HIM NOW BECAUSE HE HAD NOT HAD HIS INTERVIEW WAS YET RIGHT. IF YOUR INCOME IS GOOD FOR YOUR FOUR SHE CAN COME WITH HIM. HOPE THIS HELP.

You are correct. It is a separate I-130. There is no derivative from her fathers petition because you are a USC. You do not file a G-325 for a child. This only relates to spouse.

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

I am at the very very end of the process of bringing my two step children here permanently I would be happy to help you with anything i learned along the way. my step kids were 11, and 14. their mother signed a noterized unformal letter stating that she released all interest of her children to come live with me and their father. the jp stamped it and it has been good enough for the embassy since. my step kids went for their interview october 1st i think and because one of the birth certificates was changed recently ( we had to fix the spelling on my step son's name) they instead of approving us asked for a dna test. well we got that done and just now getting follow up apt in a few days. expect them to get approved. I have learned alot thru this process and feel like i could write a book but still so much to learn. and not 100% with all technical terms. and refused to put up a timeline because don't want too much of the details of my personal life posted on here. especially since there are a lot of haters on here as you probably read. lemme know if i can help and congrats on being approved recently:)

o and january 2012 uscis started by receiving my application for them, interview october and hopefully approval in a few days......it was a pain in the #### and anyway that i can assist somebody i would be glad to! horrible especially because my step kids mother abandoned them, they been living with sister n law and all of their crowded house in jamaica. the mother moved across the country and doesn't even call them. it has been breaking my heart that instead of being with either parent they are waiting this whole year for immigration to approve them so they could be wtih their father and me. last november i went to jamaica to fix the birth certificate, gather affadavits, get the mother to sign noterized release of kids. had to have the jp write document that he and the mother were never married, it's not good enough to not have divorce records or marriage certs they want proof that the father and mother were never married if that is the case, or proof that they are divorced.
