Work in the US (K1 visa)

Hello :)

I'm looking for some advice.

The company I work for in the UK has a US branch which I may be able to transfer to. Can someone please tell me what the process is between now (we're currently waiting on our interview date, after submitting package 3 last month)and when I should be able to legally work in the US (including timescales and any forms I need to complete/submit)?

Once you are in the US, you need to get married, after which you need to fill out your application for your temporary green card. From the day you submit until you receive the GC is about 4-5 months. Now, if you submit an application for a work permit at the same time as submitting the GC application, you may be able to get a temporary work permit a month or so before you get the GC: i..e you still have to wait 3-4 months to get that from the day you submit.

After you enter the U.S. and marry, you would need to submit the adjustment of status documentation along with the employment authorization document (EAD). You can read about the process in the VJ Adjustment of Status guide: http://www.visajourney.com/content/k1k3aos

Further down in the guide, it provides information and a link to the timelines for the EAD process. The current estimate is around 3-4 months to receive the EAD, so depending on when you enter, get married, and submit the AOS package, you can get a rough idea of when you'd be able to start working. Timeline

If you want to be able to work as soon as possible:

- Enter the US with your K-1 visa

- Get married as soon as possible

- Get a SS number no later than 2 weeks before 90 days after your entry

- Send the paperwork to adjust your status (commonly called AOS here, form I-485) + temporary work authorization (EAD, form I-765) + temporary travel document (AP, form I-131), all as soon as possible too

EAD and AP are free when filed at the same time as your AOS. EAD and AP should be approved in 2-3 months (and EAD/AP card will be good for a year), AOS is highly variable (a few month to a year).

If you know where you and your spouse want to get married, get you informed on how to get a marriage license to that place, if there's a waiting period until the ceremony, and then, how to get the marriage certificate (how long it takes, if it's free or not).
