Naturalization after VAWA

Hi,

I received my green card under Vawa. Soon I will be able to apply for citizenship. What documents should I submit with my application. Any special rules on how to complete application? I tried to do search on the form but did not find a lot of information on that. Thank you for your help.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

you have to send everything that a regular applicant does such as copy of your GC, photos, fees, divorce decree, copy of birth certificate and translation, copy of the I360 approval notice etc... When choosing the option eligibility for naturalization (question number D of Part 2) which is about your eligibility for naturalization you should choose OTHER and write-" INA sec 319 (a), and attach copy of the memo from Uscis regarding naturalization for individual with vawa approved. Make sure in your cover letter you specify your eligibility otherwise the first person touching your case might not accept your form N-400, because most of them do not know about the 3 years rule for victims of domestic violence.Do not forget to send a copy of the memorandum because some officers do not know about the 3 years rule ok.

Good luck with this part of the process. I applied last year under VAWA.

My package consisted of:

1. Completed the notification form

2. Completed application form

3. Attached copy of the I-360 approval notice

4. Attached copy of Policy Memo #89 (which shows that we can apply after 3 years) Did this just in case...

5. Attached copy of divorce decree and marriage certificate (wasn't sure if the marriage cert was needed but added it just in case...)

6. Green card - back and front

7. Check made out to US Department of Homeland Security

8. Two pictures

In Part 2: Information about your eligibility; I selected option D and wrote: "INA SEC 319 (A) allows me to file for naturalization after three years of becoming an LPR based on my obtaining my LPR under VAWA (Ex is a naturalized USC)

I took copies of everything I had sent to USCIS re the I-360 application but was asked for none of them (better to have them and not be asked). Also, get your IRS transcripts (they are free to order online/by phone) - wasn't asked for them either...

Hi! I am applying my US Citizenship now but I am confused about Part 8 should I file that also. Basically it asked about your spouse name and address but I don't know where he lives now. Please help me. Your information is appreciated.

I would think that you should be able to put UNKNOWN for the address. I was already divorced so I just put N/A for everything concerning him (are you divorced already?). Part 8F was where I put his name, etc., and that section never asked for his address. If you are filing under VAWA, I think it is understandable if you don't know his current address. Don't worry about it.
