ADVICE: UK Wedding but moving to US

Hopefully this is in the right area!

I am American and my fiance is from the UK. Initially we were planning to have a civil ceremony in the US this December/January then have our big ceremony/reception in England in June 2013. However, after researching processing times we've decided not to go down that route. We don't think we would have sufficient enough time to get his status changed and be able to travel by June for our England wedding. So now we're planning on just getting married in the UK (legal side and all) and applying for either the K-3 visa or the IR-1/CR-1 instead.

I guess my question is, is he allowed to travel back with me to the US after the marriage in the UK? Or is there any other advice on visas for our particular situation.

We are trying to find the best way around this, and it's making our heads spin!

I visited the US after being married. We were already petitioning for my CR-1 visa and had no problems at all. We got married in the US by the way.

2012-07-25: USCIS Received

2012-07-26: I-130 NOA1

2012-08-06: I-130 Approved (11 days)

He can visit you in the USA while the process is going on, but only for 90 days at a time on the Visa Waiver Program. Have you researched the UK's requirement for getting married to a foreigner? I believe you need a visa to even get married in the UK, even if you are not staying.

If he is currently in the USA, or planning to visit before the UK wedding, you might consider getting legally married in the USA and filing the I-130 soon after to speed things up- you can still have the ceremony and reception in the UK in June 2013.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I guess the big question is then if I go down the CR-1 route, WHEN will we have to apply for it? Before we get married or after we get married? We obviously don't want to be apart for 10+ months. Because England has an ESTA program, he is only allowed 90days at a time still? Or with the CR-1 in process is he allowed to stay here full stop?

You can't apply until after you are married. You can't live together full time until he has the visa. He can use the VWP to stay up to 90 days provided he can convince them he has stong ties to the UK each time he enters. You could consider a student visa or other visa to bridge the gap.

This will not be over quickly. You will not enjoy this.
