Just curious what happens

Hello,

what happens when the officer conducting the interview at the consulate thinks that petitioner's income is not high enough and that there is a possibility that the beneficiary will become a public charge? Will they allow the petitioner/beneficiary seek a joint sponsor and resubmit a new AOS package with the joint sponsor to the consulate? Or is that the end of it, and everything needs to start all over?

1. the totality of the casefile and

2. how the Interviewing Officer feels that day.

So, IF you think already it's not gonna meet the requirements then

secure a co-sponser now, and prep a new I-864 set on the co-sponser

and send it off to yer spouse,

to be presented on interview day

or - secure a co-sponser now, since you only paid the AOS fee bill today.

My earnings are above 125% of the HHS Poverty level and my employment letter and my pay stubs will prove that but I am concerned a bit. You said to mail the new I-864 set to my spouse if I do decide to get a co-sponsor. Should photocopies be sufficient?

If you haven't sent your AOS off to NVC yet than send it with your i-864 info up front. Otherwise make sure your spouse has a new i-864 packet with co-sponsor for their interview so there is no delay. Because if one is needed you will be asked.

I actually reread your post per your instructions in your signature and this is what I think you meant.

1) Submit the AOS package with no joint sponsors but have another I-864 filled by a joint sponsor with the required documents in the hands of the beneficiary to be presented during the interview IF the level of earnings of the petitioner becomes an issue.

OR

2) Redo the AOS package to include the joint sponsor and submit it to the NVC right from the beginning.

From the two options, I prefer Option 1. Is that even possible?

On the side note, do I have to sent original pay stubs or copies will do the trick?

If you haven't sent your AOS off to NVC yet than send it with your i-864 info up front. Otherwise make sure your spouse has a new i-864 packet with co-sponsor for their interview so there is no delay. Because if one is needed you will be asked.

I can see you are like me and want to sponsor your wife on your own accord. So I too agree with option #1. And just have the co-sponsor info at the ready at interview. Remember NVC accepts but the CO has final approval of your AOS. So yes hold on to co-sponsor for interview.

Just couple of more quick questions.

1) Could this potentially delay the process of issuing a visa (i.e. more time needed to review the additional AOS package, etc.)?

2) Will it be looked at strangely by a CO?

3) Will the CO ignore the joint sponsor if the petitioner's earnings are enough if joint sponsor's docs are sent upfront (wishful thinking )?
