Denied Tourist Visa Will Affect K-1?

In May of 2006 my fiance applied for a tourist visa in Managua, Nicaragua. The US embassy denied him the visa obviously because he is a 23 year old male without strong ties to his country. Will this affect our K-1 process? I have heard some people say that denied entry could cause problems. Was a denied tourist visa the same as denied entry? On the question on the I-129F that asks how we met I explained the following (paraphrased): We met in 2005...waited a year. I tried to get him to meet my parents in the US in 2006 but they denied him the visa so I went to Nicaragua for a month. I was honest and wrote all of that in the explanation of our meeting. Do you think that this could affect our K-1 because of denied entry or is this not denied entry? Thanks...Alicia

I had a similar experience. I'm the non-US spouse and before i met my husband i had applied for a business visa to the US which was denied. After this i met my husband and it was 2 years later that i applied for a K-1 visa and was approved. It didnt seem to affect my case.

A denial of a visitors visa will not have any bearing on the K-1 case, visitors visas are Non-Immigrant visas and for any reason that they suspect immigration intent they will deny it. K-1 visa is one with immigration intent.

It shouldn't affect your case, but make sure he's honest when filling out the forms, when being asked if he's been denied a visa before.

Depends on why the B2 visa was denied.

If it was denied for the reason that you suspect - failure to prove non-immigrant intent - then it should have no effect. Unless, in the course of the K1 visa application, it appears that the relationship may be intended to get into the USA the B2 route having failed.

If the B2 visa was denied for reasons of inadmissibility, then the same reasons will apply to the K1 visa. Although, in the K-visa case, some of those reaons can be waived on appeal.

Based on experieces in China: If there is an application such as K1/K3/CR1 open then you can forget about a tourist visa for your fiancee/spouse.

We were denied a tourist visa in Feb 2005 (so he could meet my family too) and approved for a K-1 this year. If I remember correctly, they ask if you were denied entry. My fiance was never denied entry into the US at POE. We did however, put that he was denied a tourist visa.

A denied entry would mean that he was denied entry at a POE, which would be more serious.

Since your fiance was denied a tourist visa, it does not seem that bad unless if you guys lie. My fiance was also denied a tourist visa about 2 years ago. He intended to get such a visa, so that he could come and visit the U.S. to see me. However, for the same reasons your fiance was denied, my Juan was also denied, he was a young college student, no strong ties to Mexico, etc. However when you file all of the forms, make sure to include all of this information so that it doesn't cause problems and you should be okay.

This is one thing you have to keep in mind for AOS you have been denied visa and not entry. Keep these things in your head .
