Like dwheels said, for combined cases, you only pay one AOS fee, but separate IV fees.

Hi Saylin,

Is that "Letter of employment" really optional to send with AOS?

My wife (the petitioner) is having trouble acquiring one from the company she works for. They keep giving lame excuses but still no letter after 2 weeks.

Here in Pakistan and in Singapore, the companies do give the employees an employment letter but my friends in the U.S say that there is no such things there.

If we send in just the following, shall it be sufficient?

1. I-864

2. IRS Tax Transcripts x 3

3. Pay stubs

4. W-2 from previous years as my wife won't get W-2 for 2012 till later in January 2013

I'm not sure what your friends are talking about. My husband had no problem getting an employment letter from his work. Is your wife going to HR for the employment letter? Has she tried just asking her manager instead? It doesn't have to be anything super fancy or super official. Just a simple letter would help. It is optional, but it helps to prove current income. Since you're including pay stubs, it's not that huge of a deal if it's not included, but if possible, try to get it.

And if you're sending in tax transcripts, W2s are NOT needed (unless your wife filed taxes jointly and needs to prove just HER income).

My wife asked her supervisor, at first he said he could do it but later he said he could not as it was supposedly a "sensitive" matter so my wife went to HR. They told her they could only state that she started working for the company from xx.xx.xxxx (mm/dd/yyyy) as (position) and has earned xxx.xxx amount of money so far. My wife agreed that it was enough but even after two weeks and my wife calling them for the letter, the HR department keeps delaying and making the excuses and not giving the letter of employment. I guess your husband was lucky or maybe working with a good company.

**My wife filed as married filing jointly for 2009 as she was still married to her ex back then, 2010 and 2011 filed as single/married filing separate.**

Jeez, that HR department headbonk.gif I'd say just send the AOS package without, cause who knows how long they'll take...
