So my boyfriend is from Haiti, and this past week he had his interview at the US embassy to see if his "tourist visa" would be denied or accepted. I had sent in the invitation letter with all my information, and everything that I was told to do. Apparently they didn't think that he would have a girlfriend in the states, so they wanted proof that I was a citizen (which I had no idea that I needed to send) and they told him he should've applied for an immigrant visa not a nonimmigrant visa, but we are not currently engaged or anything? So needless to say he was denied, and we were both heart broken. My question is...where should I go from here? What is my next step? Should we reapply or try something else? Any advice/guidance would be helpful, I am new to this and want so badly to have my boyfriend come visit me here in the states! Thank you!!'

You should go to see him. Young people from many places will almost always be denied visitors visas. It is on them to prove they have more reason to leave the US than to stay. They need things like a good job, children, a house and a spouse. Lacking that he is probably not going to get a visitors visa. If you are serious , go visit him there or in some 3rd country were he doesn't need a visa.

This will not be over quickly. You will not enjoy this.

If you don't want to visit him in Haiti go to the Dominican Republic. He can catch the Caribe Tours bus across the border. I know he does not need a visa, but I am not sure if he needs a Haitian passport. But it is BEAUTIFUL and a nice place to visit. Only a 5 hour ride for him to Santo Domingo and you guys can go anywhere you want in the DR from there. Punta Cana is 3 hours on the bus from Santo Domingo and so worth the trip. The chances of him getting a tourist visa are slim to none! So unless you are planning on doing a k-1 visa the only way you are going to see him is if you visit. And I would not advise doing a k-1 just because you want to see your bf.

You should go to see him. Young people from many places will almost always be denied visitors visas. It is on them to prove they have more reason to leave the US than to stay. Yes he had a letter from school stating that his following semester was already paid for and that he would be returning for his nursing school semester. I would love to go visit him again, but visiting can only last so long, I would love to have him here...so I will go but I want to keep trying to get him a visa as well. Thank you for the advice, I appreciate it!

Yes we have talked about the Dominican republic tool..but unfortunately it's hard to schedule long trips with my work schedule. I agree completely, the k-1 will have to wait until we are ready for that kind of thing. I just miss him so much. Thank you for the advice!

You aew confusing yourself,

If he had obtained avistor visa his visa would have been only for visting too. So I don't understand your comment. If you are trying to short-cut and obtain a vistor via for staying illegal in the US than that is not going to work.

If you wants your bf to live in the US than you are going to have to be ready to marry him and file for a finance visa or a spouse visa.

Yes right now i would like for him to be able to visit me, just like i have been able to visit him. Nothing confusing about that. And nothing illegal...im not into that? Obviously, because i am going about it the legal way to try to get him to be able to come visit. Im saying that him coming here would be easier if we could get the visa, because i can still work and i would like for him to be able to meet my family just like i have his.

For a tourist visa, no information is required from you. He's the one who's applying and only his information is required. Basically, it is up to him to apply and to satisfy the embassy that he only intends to visit and nothing else. There's unfortunately usually very little you can do to help in that process.

It definitely sounds to me like they thought he was intending to move to the US to be with you - Something he cannot do on a tourist visa - Which is why the application was denied. Could he possibly have said something or misunderstood something to make the embassy believe he was trying to immigrate?

Keep in mind that US immigration law is the only field of US law where a person is considered guilty until proven innocent - any person trying to enter the US is presumed to be an intending immigrant until the immigration officer is satisfied otherwise. Meaning it's his burden of proof to show he has every intention of returning to Haiti, and not work or overstay in the US.

I'm sorry for your situation. As far as a visa to the US goes, he could always attempt to re-apply, but unless he has any additional information or evidence of strong ties to Haiti which did not come up in the first interview, it is very unlikely he'll be granted a visa the second time around - same situation, same outcome. Unfortunately, there is no such thing as a boyfriend visa - Only spousal and fiance visas. Fortunately, if you ever do decide to get married, this denial will not have any bearing on a a future immigrant fiance or spousal visa.

As far as other options, there's always a third country visit as mentioned above.
