The USCIS homeland California sending the letter requesting evidence to complete the application. My fiance has the problem because his lawyer didn't let the judge to sign the finality of his divorce. He's been visiting in his office now and then but his lawyer keep telling him to wait. We had a lot of thing to get through this fiance visa and I am worried we might frustrate to submit all the documents needed before the deadline Oct 17,2012. The finality sign by the judge the only lacking evidence to be presented. May I ask after the deadline is there any chances that the USCIS will process even it s late?

Are you saying your fiance was not fully divorced when he sent off the fiance visa petition? If so, it will get denied, no loopholes.

If you are a day or two late they MAY accept it as it could be postal delays, but after that no, you will need to start again.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

California judges don't sign divorce papers as their normal practice. Divorce papers are filed and recorded by the family court and once that's done, that's all they are required to do. Divorce are declared final on the day the judge said so, and this would be stated on the document that states the dissolution of marriage between parties.

The divorce document you need is one that bears the "stamp of the family court" and the date it was filed and recorded.

Your fiance isnt divorced then? Which meant he wasnt free to marry when he sent the intent of marriage. If im understanding your post right.

California judges don't sign divorce papers as their normal practice. Divorce papers are filed and recorded by the family court and once that's done, that's all they are required to do. Divorce are declared final on the day the judge said so, and this would be stated on the document that states the dissolution of marriage between parties.

The divorce document you need is one that bears the "stamp of the family court" and the date it was filed and recorded.

If that did not occur prior to you applying for K-1, then it is deemed that he was not free to marry. Your petition will be denied. Otherwise, you must return the request by the deadline date, failure to do so will cause your petition to be denied.

Somthing doesn't sound right. why would his lawyer keep telling him to wait? I would have a serious conversation with your fiance to find what exactly is going on. You both do need to be free to marry before you file for the K1 Visa.

Something definitely doesnt add up and if both of you werent legally free to marry which seems like the situation here, the petition is going to be denied (a few have slipped through) base on what i have read on VJ but dont count on being that lucky. be prepared for the worst. you all need to have a serious talk with the lawyers cause all those money sucking punks wanna do is milk you of your money. good luck with your immigration journey :thumbs:

This is incorrect, at least in Los Angeles county. The judge indeed signs the final divorce judgement, it just may not happen on the day you're declared officially divorced. Mine was signed through no special request or protocol. If there was a judgement filed with the court, go to the records office and ask for a certified copy. It should have the judge's signature.
